Under the Special Marriage Act, 1954, the notice period for court marriage is 30 days. Important points: A written “Notice of Intended Marriage” is submitted to the Marriage Officer. After filing, the notice is displayed publicly for 30 days. During this 30-day period, anyone can raise a legal objection. After 30 days: If no valid objection is received, the marriage can be solemnized. Marriage is conducted before the Marriage Officer in presence of 3 witnesses. Extra details: At least one partner should generally reside in the district for 30 days before filing notice. If an objection is filed, the Marriage Officer may conduct an inquiry before proceeding. Dear Client, The notice for a court marriage in India as given by the Special Marriage Act, 1954 is thirty days. This begins from the date the Notice of Intended Marriage is officially published by the marriage officer in their office. The major purpose of this 30 day period is that upon submission of the notice the marriage officer publishes it in a conspicuous place in their office to invite any potential objections. Further the law provides this full month for the public to come forward if an objection is filed the marriage officer is legally obligated to conduct an inquiry into its validity. Moreover, if no objections are received within the 30- day notice or if any objections raised are dismissed after an inquiry the marriage can be solemnized at any time within next three months. Because this 30- day notice is a statutory requirement it cannot be waived or bypassed even if both parties are willing to pay extra fees or provide additional documentation, it serves as a fundamental check to protect the validity of the marriage before the marriage certificate is issued.
