What is diplomatic immunity in India?

Diplomatic immunity in India is a legal protection given to foreign diplomats so they can perform their official duties without interference from Indian laws or courts. It is governed mainly by the Vienna Convention on Diplomatic Relations, 1961, which India follows. Meaning: Diplomatic immunity means diplomats of foreign countries cannot be arrested, sued, or prosecuted under Indian law in most situations. Who gets diplomatic immunity: Ambassadors High Commissioners Embassy staff with diplomatic status Certain family members of diplomats Key protections: Immunity from criminal jurisdiction of Indian courts Immunity from most civil and administrative cases Protection from arrest or detention Embassy premises are considered inviolable (cannot be entered by police without permission) Limitations: Immunity applies only to official and personal acts during posting It does not mean diplomats are above all laws in absolute terms Sending country can waive immunity Diplomats must respect Indian laws and regulations If a diplomat commits an offence: India cannot directly prosecute them Government of India can: Declare them persona non grata (ask them to leave the country) Request their home country to waive immunity Expel them diplomatically Important point: Diplomatic immunity is a privilege for smooth international relations, not a personal right to commit crimes.

Dear Client, Diplomatic immunity is a form of legal protection that protects diplomats and certain other foreign officials from the jurisdiction of the host countries courts and legal processes. In India this aspect is governed by Diplomatic Relations (Vienna Convention) Act 1972, which gives effect to the Vienna Convention on Diplomatic Relation. This immunity is not intended to benefit individuals personally rather it is designed to ensure the efficient performance of diplomatic functions by preventing host governments from using the local legal system to harass or pressure foreign representatives. The extent of this immunity depends on the status of the individual under the Vienna Convention for instance diplomatic agents enjoy complete immunity from the criminal jurisdiction of India as well as immunity from civil and administrative jurisdiction with a few exceptions. Further, administrative and technical staff generally enjoy immunity regarding acts performed in the course of their official duties. Moreover, service staff and private servants immunity is typically restricted to acts performed in the course of their official duties. While diplomatic immunity provides extensive protection it must be noted that it is not an absolute license to commit crimes if a diplomat engages in serious criminal activity the host government can request the sending state to waive the diplomatic immunity. If the sending state refuses to waive it India still retains the right to declare the diplomat persona non grata effectively requiring them to be recalled or expelled from the country.
