If parents oppose court marriage in India, the marriage can still be legally performed if the couple fulfills all legal requirements under the Special Marriage Act, 1954. Dear Client, In India parental consent is not a legal requirement for conducting a court marriage provided both parties are consenting adults who meet the statutory criteria Under the Special Marriage Act 1954 any male who has completed the age of twenty one years and any female who has completed eighteen years of age and who is of sound mind may solemnize their marriage before a marriage officer without any permission or approval from their family Courts have consistently reaffirmed that the right to choose one’s life partner is a fundamental right under Article 21 of the Constitution and personal liberty cannot be overridden by parental disapproval or societal expectations. When a notice of Intended Marriage is filed it is displayed publicly for a mandatory 30 day. During this time anyone including parents may file an objection however the law is clear and objection is only legally valid if it is based on specific grounds such as one party being already married the couple being within a prohibited degree of relationship or a party lacking the mental capacity to consent Objections based solely on personal disagreement caste religion or lack of family approval are legally baseless and will be dismissed by the marriage officer after an inquiry Your parents cannot stop the marriage simply because they oppose your choice. If your parents or family members threaten Harris or attempt to use force to prevent your marriage you are entitled to seek protection You can approach the local police station to request assistance or if threats persist you may file a petition to the High Court under Article 226 for a writ of protection to ensure your safety and liberty Many couples facing such circumstances also choose to consult a family law practitioner to help manage the filing process and ensure that their rights are protected from the movement the notice is filed until the marriage certificate is issue.
