If someone misuses your photos online in India, it can amount to a cyber offence, violation of privacy, or even criminal intimidation depending on how the images are used. Here is what you should do step by step: 1. Preserve evidence immediately Take screenshots of posts, profiles, chats, and URLs Save timestamps and usernames Do not delete or engage aggressively, as evidence is important 2. Report on the platform Most social media platforms (Instagram, Facebook, X, etc.) have reporting tools for: Fake profile or impersonation Non-consensual image sharing Harassment or bullying Request takedown of the content 3. File complaint on Cyber Crime Portal Report at cybercrime.gov.in Choose “Women/Child related crime” or “Other cyber crime” Upload evidence and details of the account 4. Call Cyber Crime Helpline (1930) if urgent Especially if there is blackmail, threats, or financial extortion Quick action can help block accounts or trace offenders 5. File FIR with police or Cyber Crime Cell Legal provisions may include: IT Act, 2000 Section 66E – Violation of privacy (capturing or sharing private images without consent) Section 67 – Publishing obscene content online Section 67A – Sexually explicit material Bharatiya Nyaya Sanhita provisions for harassment, defamation, and criminal intimidation 6. Ask for content removal and blocking Police and cyber cell can: Direct platforms to remove content Block offending accounts or URLs Trace IP address of the offender 7. In serious cases (blackmail or morphed images) If photos are edited or used for extortion: It becomes a more serious cybercrime (sextortion, identity misuse, forgery) Immediate FIR and emergency reporting is required 8. Legal protection of your rights Indian courts recognize privacy as part of Article 21 (Right to Life and Personal Liberty), so unauthorized use of your images can be legally challenged. Dear Client, The very first thing you ought to do when someone uses your photos inappropriately is to gather proof. This will mean taking screenshots of the infringing content as well as noting down the URL and/or social media profile that posted the said content. The next step is to report your grievance either to the social media platform about the post and/or profile and ask for the content to be taken down. After this, you would need to compose a formal complaint either on the National Cyber Crime Reporting Portal or to your local cyber police station. Further, depending on the nature of the abuse, you can take action under the Information Technology Act, 2000, especially section 66C, which deals with identity theft, section 66E for infringement of privacy, or sections 67 and 67A, which deal with acts that involve morphed sexually explicit images. Once you have documented the evidence utilize the reporting mechanism provided by the platform where the photos have been misused Every major social media site whether Instagram Facebook X or Linkedln has specific report features for content that violates their community standard regarding harassment non consensual imagery or impersonation Select the option that most accurately describes the misuse of your photos and submit your report If the platform does not remove the content you can send a formal takedown notice to the platform’s designated Grievance officer citing the relevant provisions of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules of 2021. If the misuse involves criminal acts such as cyber stalking defamation or the creation of deepfakes you should escalate the matter by filing a formal complaint You can file an online complaint through the National Cyber Crime Reporting Portal or visit your nearest cyber cell or local police station to file an FIR under the appropriate sections of Bhartiya Nyaya Sahita and the Information Technology Act.
