Yes, but only in specific legal situations. In India, police generally cannot enter a house at night without permission, but there are important exceptions under criminal procedure law. 1. General rule Police should not enter a private house at night (sunset to sunrise) without: A search warrant from a magistrate, or Consent of the occupant This is to protect the constitutional right to privacy and dignity under Article 21. 2. When police CAN enter at night without permission Police can enter a house at night without consent or warrant in urgent situations such as: Serious cognizable offences (murder, rape, kidnapping, dacoity) Hot pursuit of a suspect who has entered the house Emergency situations where delay may lead to loss of life or destruction of evidence When a person is believed to be inside and needs immediate arrest for a serious crime To prevent imminent danger or serious breach of peace 3. Legal safeguards Even in emergency entry: Police must record reasons for such entry They must follow procedure under Bharatiya Nagarik Suraksha Sanhita, 2023 (earlier CrPC provisions on search and arrest) Excessive force or unlawful entry can be challenged in court 4. Search warrant exception Normally, searches require a magistrate’s warrant. But in urgent cases, police can conduct a search without warrant and inform the magistrate later. 5. What is NOT allowed Police cannot: Enter casually or for minor complaints at night without legal authority Harass or intimidate residents Conduct arbitrary searches without justification 6. Legal remedy if violated If police enter illegally, a person can: File complaint with senior police officers or magistrate Seek legal remedy for violation of fundamental rights under Article 21 In serious cases, initiate action for abuse of power In summary: Police generally need permission or a warrant to enter a house at night, but they can do so without permission only in urgent, serious, or emergency situations involving cognizable offences or imminent danger.

Dear Client, In general terms, police officers are not allowed to intrude into someone’s home during night hours without permission or a proper warrant. However, some exceptions are possible under Indian criminal law, with respect to the Bharatiya Nagarik Suraksha Sanhita, 2023 (formerly called the Code of Criminal Procedure). In scenarios where an officer is making an arrest legally or chasing a suspect for a cognizable crime, he can enter a location without consent if he has reasons to believe that the suspect is hiding there. The law mentions several such exceptions (Section 44, BNSS). Another example of this kind is police officers being allowed to perform the search without a warrant in case they believe that if they were to delay obtaining a search warrant, they would lose possible evidence (Section 193, BNSS). Even though there are certain exceptions to the rule, powerful procedural safeguards are still present. For instance, if the premises belong to a woman who is not accustomed to appearing in public, it is necessary to inform her and provide her with an opportunity to leave before entering the place. To arrest a woman after sunset also requires permission from a Judicial Magistrate. Hence, while exceptions exist in terms of entering the house without consent in cases of urgency, there are still certain limitations to it. I hope this answer helps.
