What happens if a person does not appear after receiving court summons?

If a person does not appear after receiving court summons in India, the court can take strict legal action depending on the nature of the case and whether the absence is willful. 1. Issuance of bailable or non-bailable warrant If the person fails to appear: First, the court may issue a bailable warrant If they still do not appear, a non-bailable warrant (NBW) can be issued Police can arrest the person and produce them before court 2. Declaration as “Proclaimed Offender” or “Absconder” In serious cases: The court can declare the person a proclaimed offender Property can be attached or seized The person’s name may be published as absconding 3. Adverse inference in the case Non-appearance can: Weaken the person’s defence Lead the court to proceed ex parte (decide without hearing them) in civil cases Be treated as non-cooperation in criminal cases 4. Civil case consequences If it is a civil matter: The court may pass an ex parte judgment against the absent party They lose the chance to present their side unless the order is set aside later 5. Criminal case consequences If it is a criminal matter: Trial can proceed in some cases (especially where presence is not essential at every stage) Bail conditions may be cancelled if already on bail Arrest becomes legally possible 6. Contempt or additional legal action In some situations: Willful disobedience of court summons may amount to contempt of court Additional charges or legal consequences may arise depending on facts 7. Possible relief later The person can still: Apply for cancellation of warrant Seek bail or anticipatory bail (if eligible) Request the court to set aside ex parte orders by showing sufficient cause 8. Important legal principle Court summons are a legal command, not a request. Ignoring them can lead to arrest and adverse legal consequences. In summary: If a person does not appear after receiving court summons, the court can issue warrants, proceed ex parte, declare them absconding in serious cases, and even order arrest through police.
