In India, an accused person has several important legal and constitutional rights to ensure a fair investigation and fair trial. These rights mainly come from the Constitution of India and criminal procedure laws (Bharatiya Nagarik Suraksha Sanhita, 2023 and related laws). 1. Right to be informed of the offence The accused must be told clearly why they are being arrested or charged Grounds of arrest must be communicated 2.
