A person cannot remove their name from an FIR by themselves. The name can only be removed through the legal process. If the person is falsely implicated, they can take the following legal steps: During Police Investigation Submit evidence to the Investigating Officer showing that they were not involved. Provide documents, CCTV footage, call records, location data, witness statements, or any other material supporting their innocence. If the investigation finds no evidence against them, the police may exclude their name from the final report submitted to the court. Approach the High Court If the FIR is false, malicious, or does not disclose any offence, the person may file a petition before the High Court seeking quashing of the FIR under the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS). The High Court may quash the FIR if it finds that continuing the criminal proceedings would amount to an abuse of the legal process. Apply for Anticipatory Bail If there is a risk of arrest in a non-bailable offence, the person may apply for anticipatory bail while challenging the allegations. Discharge Before Trial If the police file a charge sheet but there is insufficient evidence, the accused may apply for discharge before the trial court. If the court finds no sufficient grounds to proceed, it may discharge the accused. Acquittal After Trial If the case proceeds to trial and the prosecution fails to prove the allegations beyond reasonable doubt, the court may acquit the accused. Action Against a False Complainant If it is established that the FIR was intentionally false or malicious, the accused may seek legal action against the complainant, depending on the facts and the applicable provisions of law. Important: A police officer cannot simply delete a person's name from a registered FIR. However, after investigation, the police may conclude that there is no evidence against that person and omit their name from the final report submitted to the court. Ultimately, the court has the authority to decide whether criminal proceedings should continue against a person.
