How does India deal with cross-border cyber crimes?

Cross-border cyber crimes are offences where the offender, victim, computer system, server, or digital evidence is located in different countries. India addresses such crimes through a combination of domestic laws and international cooperation. Indian law enforcement agencies investigate offences under the Bharatiya Nyaya Sanhita, 2023 (BNS), the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), the Information Technology Act, 2000 (where applicable), and other relevant laws. Cyber Police Stations, State Cyber Crime Cells, and central agencies coordinate to investigate cross-border cyber offences involving: Online financial fraud. Hacking and unauthorized access. Identity theft. Phishing scams. Ransomware attacks. Child sexual exploitation online. Cyber terrorism and other serious cyber offences. Indian authorities may seek information from foreign governments or service providers through Mutual Legal Assistance Treaties (MLATs), letters rogatory, or other international legal cooperation mechanisms, depending on the country involved. Law enforcement agencies may request: Subscriber information. Server logs. IP address details. Transaction records. Digital evidence stored on foreign servers. India also cooperates with international organizations and foreign law enforcement agencies to identify suspects, preserve electronic evidence, and coordinate investigations in appropriate cases. Digital evidence must be collected and preserved in accordance with Indian law so that it can be used during criminal proceedings. If a cyber crime affects a person or computer system in India, Indian authorities may investigate the offence even if some part of the criminal activity occurred outside India, subject to applicable laws and international cooperation. Victims should report cross-border cyber crimes immediately to: The nearest Cyber Police Station. Any police station, which may register a Zero FIR where appropriate. The National Cyber Crime Reporting Portal for eligible cyber crime complaints. Because cyber criminals often operate across multiple countries, investigations may take longer than domestic cases due to the need for international cooperation, evidence sharing, and compliance with the laws of the countries involved.
