Is recording video calls without permission illegal?

In India, there is no single law that makes recording every video call without permission automatically illegal. Whether it is lawful depends on the purpose, the circumstances, and how the recording is used. If you are a participant in the video call: Recording the conversation is not automatically a criminal offence merely because the other person was not informed. However, using the recording to harass, blackmail, threaten, defame, or violate another person's privacy may lead to civil or criminal liability. If you are not a participant in the video call: Secretly intercepting or recording someone else's video call without lawful authority may amount to illegal surveillance and can attract legal consequences under applicable laws. Sharing or publishing a recorded video call without consent may result in legal action if it: Violates a person's privacy. Contains intimate or sexually explicit content. Defames a person. Is used for extortion or blackmail. Violates any court order or legal restriction. If the recording contains intimate images or videos, sharing or transmitting them without consent may amount to serious offences under the Bharatiya Nyaya Sanhita, 2023 (BNS) and the Information Technology Act, 2000, depending on the facts of the case. A recording may be used as evidence in legal proceedings if the court finds it to be relevant, authentic, and legally admissible. The court decides its evidentiary value on a case-by-case basis. If the recording was made by an employer, institution, or platform, additional legal obligations relating to privacy, consent, and data protection may apply. Therefore, recording your own video call is not automatically illegal in India, but using or disclosing the recording in a manner that violates another person's rights or breaks the law can result in legal consequences.
