India cooperates with other countries in criminal investigations through international treaties, domestic laws, and mutual legal assistance mechanisms. This cooperation is particularly important in cases involving cyber crime, terrorism, money laundering, human trafficking, drug trafficking, financial fraud, and other transnational offences. The primary methods of cooperation include: Mutual Legal Assistance Treaties (MLATs) India exchanges evidence and legal assistance with countries that have MLATs. Assistance may include obtaining documents, recording witness statements, executing search and seizure requests, identifying suspects, and tracing criminal assets. Letters Rogatory If there is no applicable treaty or where required, an Indian court may issue a Letter Rogatory requesting a foreign court to assist in collecting evidence or carrying out specific investigative steps. Extradition India may request another country to surrender a person accused or convicted of an offence in India. Likewise, India may extradite a person to another country in accordance with the Extradition Act, 1962, applicable treaties, and judicial procedures. INTERPOL Cooperation Indian law enforcement agencies work with INTERPOL through the National Central Bureau (NCB-India), which functions under the Central Bureau of Investigation (CBI). INTERPOL facilitates the exchange of criminal intelligence, tracing fugitives, locating missing persons, and issuing notices such as Red Notices. Information Sharing Indian authorities may share and obtain information relating to: Bank records. Digital evidence. Subscriber information. Travel and immigration records. Corporate and financial records. Other evidence relevant to the investigation. Joint Investigations In appropriate cases, Indian authorities may coordinate with foreign law enforcement agencies to investigate offences spanning multiple jurisdictions. Asset Tracing and Recovery India cooperates with foreign authorities to identify, freeze, seize, and recover proceeds of crime that have been transferred across borders, subject to applicable laws and international agreements. Legal Framework International cooperation in criminal matters is governed by the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), the Extradition Act, 1962, the Prevention of Money Laundering Act, 2002 (where applicable), and relevant international treaties and agreements. Safeguards Requests for international assistance generally require compliance with legal procedures in both countries. Foreign authorities are not required to comply automatically and may refuse assistance if the request conflicts with their domestic laws, sovereignty, public policy, or treaty obligations. Because criminal investigations often involve multiple jurisdictions, international cooperation helps ensure that offenders cannot easily avoid prosecution by moving evidence, money, or themselves to another country.

Under Section 112 of the Bharatiya Nagarik Suraksha Sanhita, 2023, an Indian Criminal Court can issue a letter of request to a foreign court or competent authority to obtain evidence, documents or statements required for an investigation.
