RBI's Digital Lending Guidelines, 2022 and the associated Fair Practices Code require every digital lender to be either RBI-regulated or operating through a regulated entity, and expressly prohibit accessing a borrower's contact list, photos, or location data, sending shaming messages to third parties, and calling outside 8 AM to 7 PM. A complaint against a registered lender goes to the RBI Ombudsman; against an unregistered or unauthorised app, the correct forum is the Sachet portal (sachet.rbi.org.in), which routes the complaint to the State Level Coordination Committee and onward to police. Where the conduct crosses into threats or coercion, criminal remedies exist independently of the regulatory route. Threatening injury to reputation or person to compel payment falls within criminal intimidation under Section 351 BNS (formerly Section 503 IPC), and using such threats to extract money constitutes extortion under Section 308 BNS (formerly Section 383 IPC). Unauthorised access to phone data or morphing images for shaming purposes can fall under the Information Technology Act, 2000, and should be reported through cybercrime.gov.in or the 1930 helpline.
