Dear Client, Yes, anticipatory bails are granted for cybercrime cases in India, but provided certain conditions are fulfilled. Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, governs anticipatory bail. It allows a person to be released on bail even before arrest for a non-bailable offense, many of which are cybercrimes. Anticipatory bail in such instances can be granted by the Sessions Court or the High Court. Courts in cases of serious cybercrimes, especially huge financial fraud, threat to national security, etc., are very careful while granting anticipatory bail petitions. For example, the Karnataka High Court in April 2025 rejected anticipatory bail matters relating to a high stake case of data theft involving sensitive national defense information, keeping in view of further increasing due diligence in these matters. In conclusion, however, though anticipatory bail is applicable for cybercrimes in India, the approval to such request shall be subject to the discretion of the court in relation to the case at hand.
