Dear Client, As a general rule, the grant of anticipatory bail in cases of terrorism is extremely limited. The majority of terrorism cases are filed under special legislation like the Unlawful Activities (Prevention) Act, 1967 (UAPA) or the National Investigation Agency Act, 2008, both of which have strict bail provisions. Section 43D(4) of the UAPA excludes specifically granting anticipatory bail. According to it, the provisions of Section 438 of the Code of Criminal Procedure (CrPC), which is for anticipatory bail, shall not be applicable to those accused of offenses under Chapters IV and VI of the UAPA that cover terrorist acts and terrorist groups. Courts have found the legislative intention to avoid abuse of the power of anticipatory bail in matters relating to national security. Anticipatory bail is therefore not sustainable if the accused has been charged with an offence under the provisions. But where an individual has simply been named or apprehends false implication under a broad criminal legislation without the use of special terrorism legislation, anticipatory bail may still be entertained by the court on a situational basis after evaluating the seriousness and nature of the charges.
