Dear Client, Preventive detention does not allow for the granting of anticipatory bail under Section 438 of the Criminal Procedure Code (CrPC). According to laws like the National Security Act or comparable State Acts, preventive detention is a measure to stop someone from committing acts that could jeopardize public order or national security rather than a routine arrest for a specific offense. Instead of requesting anticipatory bail the remedy for preventive detention is to contest the detention order in writ petitions for habeas corpus before the High Court or Supreme Court in accordance with Articles 226 and 32 of the Constitution.
