Establishing clear and undisputed ownership of an immovable property in India requires a comprehensive paper trail consisting of several crucial legal documents. No single document in isolation provides absolute proof of ownership, as Indian property law relies on a chain of custody and registration to verify title validity. 1. Sale Deed is the primary document that transfers ownership of a property from the seller to the buyer. It must be executed on appropriate non-judicial stamp paper and compulsorily registered at the office of the Sub-Registrar under the Registration Act, 1908. Without a registered Sale Deed, no right, title, or interest in the property passes to the purchaser, except in cases of allotment by development authorities or court decrees. 2. Mother Deed is a comprehensive historical document that traces the ownership of the property from its origin to the present day. It establishes the continuity of ownership and helps verify whether the current seller has the legal capacity to sell the property. It includes a sequence of previous sale deeds, partition deeds, gift deeds, or inheritance documents. If the original mother deed is missing, certified copies must be obtained from the sub-registrar office, and public notices should be issued to ensure there are no adverse claims. 3. Khata Certificate and Khata Extract are crucial municipal records maintained by local urban bodies like the Bruhat Bengaluru Mahanagara Palike, Municipal Corporations, or Village Panchayats. The Khata certificate identifies the person liable to pay property taxes and proves that the property is entered in municipal registers. The Khata extract details the property size, location, use, and assessment value. While Khata does not prove absolute title, it is essential for obtaining bank loans, building permits, and paying utility bills. 4. Encumbrance Certificate (EC) is issued by the Sub-Registrar office where the property is registered. It contains details of all registered transactions, mortgages, leases, or legal charges attached to the property over a specific period. A clean EC covering the past 15 to 30 years proves that the property is free from any monetary liabilities, mortgages, or legal disputes, ensuring the title is marketable. 5. Property Tax Receipts issued by the local municipal authority demonstrate that the owner has been regularly paying taxes on the property. Possession of up-to-date tax receipts reinforces continuous possession and ownership, acting as corroborative evidence in property disputes. 6. Mutation Record or Patta is maintained by the state revenue department and records the transfer of ownership in government revenue registers. When a property is purchased or inherited, an application for mutation is filed so that the revenue records reflect the current owner's name. Patta is vital for agricultural and non-agricultural lands to establish possession and revenue liability. 7. Approved Building Plan and Occupancy Certificate (OC) are issued by the local planning authority. The approved plan proves that the construction complies with local zoning laws and municipal bylaws. The Occupancy Certificate, issued after construction completion, certifies that the building is safe for habitation and complies with the sanctioned plan, protecting the buyer from unauthorized or illegal construction issues. 8. Allotment Letter and Possession Certificate are issued by housing boards, development authorities, or cooperative housing societies when a property is allotted to a person. The allotment letter details the property specifications and cost, while the possession certificate establishes the exact date on which physical possession was handed over to the allottee. 9. Will, Gift Deed, or Partition Deed serve as proof of ownership when property is acquired through inheritance, a gift, or division among family members. A Will must be probated in certain jurisdictions, while Gift Deeds and Partition Deeds must be registered under the Registration Act, 1908, to be legally valid and effective for transferring ownership rights.
