Yes, foreigners can get married through court marriage in India. The Special Marriage Act, 1954, provides for the solemnization of marriages between Indian nationals and foreigners, or between two foreigners, in India. To get married through court marriage in India, the foreign national must meet the eligibility requirements prescribed under the Special Marriage Act, which include: The foreign national must have a valid visa to stay in India. The foreign national must not be suffering from any mental illness or any other condition that makes them unfit for marriage. The foreign national must not be within the degree of prohibited relationship as per the law applicable to the parties. The foreign national must be above the age of 18 years, and if the foreign national is a female, she must not be below the age of 21 years. The procedure for court marriage for foreigners is the same as that for Indian nationals. The foreign national must give notice of intention to marry to the marriage officer at least 30 days prior to the date of marriage, and the marriage must be solemnized in the presence of the marriage officer and two witnesses. Additionally, foreigners must also provide additional documents such as a copy of their passport, a certificate of no impediment to marriage from their country of origin, and a declaration of their intention to marry, duly notarized and apostilled by the appropriate authorities in their country of origin. It is advisable to consult with a lawyer or a marriage officer to understand the eligibility requirements and the procedure for court marriage for foreigners in India.
