Yes, there is a minimum age requirement for individuals to marry in court in India. The legal minimum age for marriage is governed by the Prohibition of Child Marriage Act, 2006, which sets forth the following provisions regarding the age of marriage: Minimum Age for Marriage: The minimum age for marriage is 18 years for females and 21 years for males. This applies to both court marriages and marriages conducted through traditional ceremonies. Exceptions: There are certain exceptions to the minimum age requirement under specific circumstances: For females between 18 and 21 years and males between 21 and 23 years, marriage is permissible with the consent of their parents or guardians and with the approval of the appropriate authority. In cases where a court grants special permission, a minor below the minimum age may marry under exceptional circumstances, subject to the court's conditions and considerations of the minor's welfare. Prohibition of Child Marriage: The Prohibition of Child Marriage Act, 2006, prohibits the solemnization of child marriages. A child marriage is defined as any marriage where either party is below the legal minimum age specified by law. Penalties: Violation of the prohibition on child marriage, including solemnizing, arranging, or participating in child marriages, is punishable under the Act with imprisonment and fines. Consent: Even when the minimum age requirement is met, valid consent from both parties is essential for the marriage to be legally recognized. Consent must be given voluntarily, without coercion, fraud, or undue influence. Legal Recognition: Marriages that comply with the minimum age requirement and other legal formalities, including registration as per applicable laws, are legally recognized in India. It's important to note that the legal minimum age for marriage is designed to protect individuals, particularly minors, from the potential risks and consequences associated with early or forced marriages. Adherence to the minimum age requirement and compliance with relevant laws ensure that marriages are entered into with full understanding, maturity, and consent of the parties involved.
