Here's how these types of online fraud are addressed under Indian law: Phishing: Phishing involves fraudulent attempts to obtain sensitive information, such as usernames, passwords, credit card details, or other personal information, by impersonating a legitimate entity or organization. Phishing attacks are typically carried out through deceptive emails, websites, or messages.Under the IT Act, phishing activities can be prosecuted under various provisions, including: Section 43: Unauthorized access to computer systems or data. Section 66: Computer-related offenses, including hacking. Section 66C: Identity theft, which includes impersonation or using a person's identity for fraudulent purposes. Identity Theft: Identity theft involves stealing someone's personal information, such as their name, date of birth, social security number, or financial details, with the intent to impersonate or defraud the victim. Identity theft can lead to financial loss, reputational damage, and other adverse consequences for the victim.Under the IT Act, identity theft is explicitly recognized as an offense under Section 66C, which provides for punishment for identity theft and unauthorized use of electronic signature, password, or any other unique identification feature of any other person. In addition to the IT Act, other relevant laws and provisions may also apply to prosecute online fraud and cybercrimes in India. For example, the Indian Penal Code (IPC) contains provisions related to cheating, fraud, impersonation, and other offenses that may be applicable in cases of online fraud and identity theft.
