Obtaining motor insurance in India involves complying with various legal requirements and procedural steps. Motor insurance is mandatory under Indian law, specifically the Motor Vehicles Act, 1988, and is essential for both financial protection and legal compliance. Here are the key legal requirements and steps for obtaining motor insurance in India: 1. Legal Requirement Mandatory Insurance: Under Section 146 of the Motor Vehicles Act, 1988, it is mandatory for all motor vehicles to have at least a third-party liability insurance policy. This insurance covers damages or injuries caused to third parties (including other vehicles, pedestrians, and property) in the event of an accident. 2. Types of Motor Insurance Third-Party Liability Insurance: Covers legal liabilities for injuries or damages caused to third parties in an accident. It does not cover damages to the insured vehicle itself. Comprehensive Insurance: Provides coverage for both third-party liabilities and damages to the insured vehicle due to accidents, theft, fire, natural calamities, and other risks. It also offers coverage for personal injuries. 3. Eligibility Criteria Vehicle Registration: The vehicle must be registered with the local Regional Transport Office (RTO). A valid Registration Certificate (RC) is required to obtain insurance. Age and Licensing: The vehicle owner must possess a valid driving license. The age of the vehicle may also affect the terms and premium of the insurance policy. 4. Documentation Required Vehicle Registration Certificate (RC): Proof of vehicle registration with the RTO. Driving License: A valid driving license of the person who will be driving the vehicle. Previous Insurance Policy (if applicable): For renewals, a copy of the previous insurance policy is needed to continue coverage and transfer the No Claim Bonus (NCB). Identity Proof: Proof of identity of the vehicle owner, such as an Aadhaar card, passport, or voter ID. Address Proof: Proof of address, such as a utility bill, rental agreement, or bank statement. 5. Procedure for Obtaining Insurance Choose an Insurance Provider: Select a licensed insurance company or provider. You can compare different insurance providers and their policies through online platforms or directly with insurers. Application Form: Fill out the insurance application form, providing details about the vehicle, its usage, and personal information. Inspection: Some insurers may require a physical inspection of the vehicle, especially for comprehensive insurance. The inspection verifies the condition of the vehicle and assesses the risk. Premium Payment: Pay the insurance premium as determined by the insurance provider. The premium is based on factors such as the vehicle’s make, model, age, and usage. Policy Issuance: After processing the application and payment, the insurer will issue the insurance policy. You will receive a policy document that outlines the coverage, terms, and conditions. 6. Policy Terms and Coverage Coverage Details: Review the policy document carefully to understand the coverage, including third-party liability, comprehensive coverage, exclusions, and additional benefits. Policy Period: Motor insurance policies are typically valid for one year. Ensure timely renewal to avoid lapses in coverage. 7. Renewal of Insurance Renewal Process: Motor insurance must be renewed before the expiry of the policy period. Renewal can be done online or through the insurance provider’s office. No Claim Bonus (NCB): If no claims have been made during the previous policy period, you may be eligible for a No Claim Bonus, which can reduce the premium for the renewed policy. 8. Legal Compliance Display of Insurance Certificate: While it is not mandatory to display the insurance certificate on the vehicle, it must be carried while driving, as it may be requested by authorities during checks. Penalties for Non-Compliance: Driving a vehicle without insurance is an offense under the Motor Vehicles Act and may result in penalties, fines, and legal consequences. Conclusion Obtaining motor insurance in India involves adhering to legal requirements under the Motor Vehicles Act, 1988, and involves choosing the right type of insurance, providing necessary documentation, and following the application and renewal procedures. Third-party liability insurance is mandatory, while comprehensive insurance offers broader coverage. Ensuring compliance with these requirements helps protect both the vehicle owner and other parties involved in any incidents.

Dear Client, as per your query, under the Motor Vehicles Act of 1988, every motor vehicle used in public places in India must be insured for at least Third-Party Liability Insurance. This will protect you against the liabilities if someone is injured, dies, or property is damaged to a third party. According to the IRDAI regulations, new cars are to be insured for three years for third-party liability, and new bikes are to be insured for five years for third-party liability. For purchasing or renewing, you will require some basic documents: the Registration Certificate (RC), a valid driving license, ID and address proofs (such as Aadhaar, PAN, or passport), your vehicle details (engine and chassis numbers), and for renewals, details of your previous policy. Digital copies are also acceptable if they are stored in DigiLocker or mParivahan. I hope this answer is helpful. In case of further queries, please do not hesitate to contact us. ThankYou.
