The Central Industrial Security Force Act, 1968

Section 1 Short title, extent and commencement.

(1) This Act may be called the Central IndustrialSecurity Force Act, 1968. (2) It extends to the whole of India. (3) It shall come into force on such date1as the Central Government may, by notification in theOfficial Gazette, appoint.

Section 2 Definitions.

(1) In this Act, unless the context otherwise requires, 1(a) "Director-General" means the Director-General of the Force appointed under section 4; (aa) "enrolled member of the Force" means any subordinate officer, under officer or any othermember of the Force of a rank lower than that of an under officer; (ab) "Force" means the Central Industrial Security Force constituted under section 3; (ac) "Force custody" means the arrest or confinement of a member of the Force in accordancewith rules made under this Act; (b) "industrial undertaking" means any undertaking pertaining to a scheduled industry andincludes an undertaking engaged in any other industry, or in any trade, business or service which maybe regulated by Parliament by law; (c) "industrial undertaking in public sector" means an industrial undertaking owned, controlled ormanaged by (i) a Government company as defined in section 617 of the Companies Act, 1956 (1 of 1956), (ii) a corporation established by or under a Central, Provincial or State Act, which iscontrolled or managed by the Government; 2[(ca) "industrial establishment" means an industrial undertaking or a company as defined undersection 3 of the Companies Act, 1956 (1 of 1956),or a firm registered under section 59 of the IndianPartnership Act, 1932 (9 of 1932),which is engaged in any industry, or in any trade, business orservice;] 3[(cb) "joint venture" means a venture jointly undertaken by the Central Government or StateGovernment with private industrial undertaking;] 4* * * * * (e) "Managing Director", in relation to an industrial undertaking, means the person (whethercalled a managing agent, general manager, manager, chief executive officer or by any other name)who exercises control over the affairs of that undertaking; (f) "members of the Force" means a person appointed to the Force under this Act 5* * *; (g) "prescribed" means prescribed by rules made under this Act; 6['(ga) "private industrial undertaking" means an industry owned, controlled or managed by aperson other than the Central or State Government or any industrial undertaking in public sector;'] (h) "scheduled industry" means any industry engaged in the manufacture or production of thearticles mentioned in the First Schedule to the Industries (Development and Regulation) Act, 1951(65 of 1951); 7['(ha) "subordinate officer" means a person appointed to the Force as an Inspector, a SubInspectoror an Assistant Sub-Inspector;';] (i) "supervisory officer" means any of the officers appointed under section 4 and includes anyother officer appointed by the Central Government as a supervisory officer of the Force. 7['(j) "under officer" means a person appointed to the Force as a Head Constable, Naik or LanceNaik.'] 8[(2) Any reference in this Act to a law which is not in force in any area shall, in relation to that area,be construed as a reference to the corresponding law, if any, in force in that area.]

Section 3 Constitution of the Force.

(1) There shall be constituted and maintained by the CentralGovernment 1[an armed force of the Union] to be called the Central Industrial Security Force for thebetter protection and security of industrial undertakings owned by that Government2[,joint venture orprivate industrial undertaking]3[and to perform such other duties as may be entrusted to it by theCentral Government.] (2) The Force shall be constituted in such manner, shall consist of such number of 4[supervisoryofficers, subordinate officers, under officers and other enrolled] members of the Force who shall receivesuch pay and other remuneration as may be prescribed.

Section 4 Appointment and powers of supervisory officers.

1[(1) The Central Government may appoint aa person to be the Director-General of the Force and such other supervisory officers as considerednecessary.] (2) The 2[Director-General] and every other supervisory officer so appointed shall have, and mayexercise, such powers and authority as is provided by or under this Act.

Section 5 Appointment of enrolled members of the Force.

The1[appointment of the enrolled members ofthe Force shall rest with the Director-General] who shall exercise that power in accordance with rulesmade under this Act: Provided that the power of appointment under this section may also be exercised by such othersupervisory officer as the Central Government may by order specify in this behalf.
