The Cattle-Trespass Act, 1871

1 [1. Title and extent.--(1) This Act may be called the Cattle-trespass Act, 1871; and (2) It extends to the whole of India except 2[the territories which, immediately before the 1stNovember, 1956, were comprised in Part B States], and the presidency-towns and such local areas as theState Government, by notification in the Official Gazette, may from time to time exclude from itsoperation. 3[* * * * *] STATE AMENDMENT Maharashtra.-- Amendment of section 1 of Act 1 of 1871.--In section 1 of the Cattle-trespass Act, 1871, in itsapplication to the State I of Bombay (hereinafter referred to as the "principal Act"), to sub-section (2) the1871, following proviso shall be added, namely:-- "provided that on the commencement of the Cattle-trespass (Bombay Extension and Amendment)Act, 1959 (Bom. XIII of 1959), it shall extend to those areas in which the Hyderabad, Cattle TrespassAct, or as the case may be the Cattle-trespass Act, 1871 (Hyd. Act V of 1837, 1 of 1871), as modified andapplied to the Saurashtra area of the State of Bombay was in force immediately before suchcommencement." [Vide Bombay Act XIII of 1959, s. 3]

In this Act,-- "officer of police" includes also village-watchman, and "cattle" includes also elephants, camels, buffaloes, horses, mares, geldings, ponies, colts, fillies,mules, asses, pigs, rams, ewes, sheep, lambs, goats and kids 1[, and 2"local authority" means any body of persons for the time being invested by law with the controland administration of any matters within a specified local area, and "local fund" means any fund under the control or management of a local authority.

Pounds shall be established at such places as the Magistrate of theDistrict, subject to the general control of the State Government, from time to time directs. The village by which every pound is to be used shall be determined by the Magistrate of the District.

The pounds shall be underthe control of the Magistrate of the District; and he shall fix, and may from time to time alter, the rates ofcharge for feeding and watering impounded cattle.
