How Is Disability Pension Calculated for Ex-Servicemen?

Answer By law4u team

The disability pension for ex-servicemen is provided to compensate for any service-related disability that prevents them from continuing in their service or affects their ability to work. The pension amount is determined based on the severity of the disability, the soldier’s length of service, and their rank at the time of discharge.

Calculation of Disability Pension:

Disability Percentage:

The disability percentage is assessed by a medical board, which determines the extent of the disability. Disabilities are categorized as:

Percentages range from 20% to 100%, and the pension amount increases with the disability percentage.

Two Types of Pension:

Disability Pension (for those invalidated out of service):

For soldiers who are medically discharged due to service-related disabilities, this pension is based on their last pay drawn and the disability percentage.

Disability Element (for soldiers who continue in service but have a disability):

If the soldier continues to serve but has a disability, the disability pension is calculated based on the percentage of disability and the pay band applicable to their rank.

Disability Pension Formula:

For invalided out personnel, the formula for calculating the disability pension is as follows:

Pension = Last Pay Drawn × (Disability Percentage / 100) × Service Length Factor

Service Length Factor is based on the soldier’s years of service at the time of discharge.

Type of Disability:

If the disability is categorized as being aggravated by service, the full pension may be granted. If the disability is not related to service, the soldier may be entitled only to a service pension instead of a disability pension.

Minimum and Maximum Disability Pension:

Minimum pension is typically provided for those with low disability percentages (usually starting from 20%).

Maximum pension is granted for 100% disability, and the rate depends on the rank and length of service.

Broad Structure:

Ex-servicemen are also eligible for Disability Pension with Family Pension in case of death due to service-related disability.

Disability pension is adjusted for inflation and reviewed periodically by the government.

Example:

An ex-serviceman who served for 15 years in the army and is invalided out due to a 50% disability will have his pension calculated as follows:

His last pay drawn (basic pay) is considered.

The disability percentage (50%) is applied to the pension calculation.

A service length factor is applied based on the number of years served.

For instance, if the last pay drawn was ₹40,000 per month, and the service length factor is 15, the pension might be calculated as:

Pension = 40,000 × (50 / 100) × 15 = ₹3,00,000 (annual pension)

This amount would be subject to adjustments based on the exact calculation methods and guidelines followed by the government.
