How Is RERA Enforced?

Definition: The Real Estate (Regulation and Development) Act, 2016 (RERA) is enforced to regulate the real estate sector, protect homebuyers' interests, and ensure transparency in real estate projects. RERA establishes guidelines that real estate developers, agents, and buyers must follow.

How RERA is Enforced:

1. State-Level RERA Authorities:

Establishment of RERA Authorities: Each state establishes its own Real Estate Regulatory Authority (RERA) to oversee and regulate real estate transactions within the state.

Registration of Projects: Developers must register all real estate projects with the state’s RERA authority before marketing or selling any property. Unregistered projects cannot be sold.

2. Mandatory Disclosures by Developers:

Project Information: Developers are required to provide detailed project information, including land status, approvals, timelines, and financial disclosures, to the RERA authority.

Transparency: The authority ensures that buyers have access to verified and complete information about projects, including completion timelines and legal clearances.

3. Protection for Homebuyers:

Grievance Redressal: If buyers face issues such as delayed possession, false promises, or project changes, they can file complaints with RERA.

Resolution of Disputes: RERA authorities hear these complaints and resolve disputes through an established legal framework, issuing penalties or directing compensation where necessary.

4. Penalties for Non-Compliance:

Fines and Imprisonment: Developers and agents who violate RERA regulations, such as failing to register projects or not adhering to project deadlines, can face fines, imprisonment, or both.

Cancellation of Registration: The RERA authority has the power to revoke the registration of a project in case of repeated violations, preventing further sale or advertising.

5. RERA Appellate Tribunal:

Appeal Mechanism: If any party is dissatisfied with a RERA decision, they can appeal to the Real Estate Appellate Tribunal (REAT), which enforces the legal rights of all stakeholders.
