What Is the Fine for Obstructing a Public Road with Your Vehicle?

Steps to Take After Causing Obstruction

Immediate Action:

If your vehicle is causing an obstruction, promptly move it to a safe location to allow traffic to pass.

Notify Authorities:

In cases where the vehicle cannot be moved due to mechanical failure, inform local traffic authorities about the situation.

Cooperate with Removal Procedures:

If the vehicle is towed by authorized agencies, ensure timely payment of any removal and storage charges to avoid further penalties.

Legal Actions and Protections

Penalty for Obstruction:

Under Section 201 of the Motor Vehicles Act, 1988, a person who leaves a vehicle on a public place in such a manner as to cause an impediment to the free flow of traffic is liable for a penalty up to ₹500, as long as the vehicle remains in that position.

Removal Charges:

If the vehicle is removed by an agency authorized by the Central or State Government, removal charges shall be recovered from the vehicle owner or person in charge of such vehicle.

Exemptions:

This section does not apply where the motor vehicle has suffered an unforeseen breakdown and is in the process of being removed.

Example

A vehicle owner parks their car on a busy Ahmedabad street during peak hours, causing significant traffic congestion. According to Section 201 of the Motor Vehicles Act, 1988, the owner could be fined up to ₹500 for obstructing the free flow of traffic. Additionally, if the vehicle is towed by authorized personnel, the owner would be responsible for the towing and storage charges.
