What documents are required to file a consumer complaint?

Answer By law4u team

Filing a consumer complaint involves providing certain documents to support the consumer's claim. These documents are crucial in helping the Consumer Forums assess the validity of the complaint and take necessary actions. According to the Consumer Protection Act, 2019, the consumer needs to submit proof of purchase, evidence of the issue, and any communication between the consumer and the business or service provider. The right documentation ensures that the case is processed smoothly and efficiently.

Essential Documents Required to File a Consumer Complaint

  • Complaint Letter:
    • A clear and concise complaint letter outlining the nature of the complaint, the facts of the case, the issue with the product or service, and the expected resolution. It should include:
      • Date of purchase or service.
      • Name and details of the business or service provider.
      • Description of the problem encountered.
      • Steps taken by the consumer to resolve the issue (if any).
  • Proof of Purchase:
    • A copy of the purchase receipt, invoice, or bill is mandatory to verify the transaction. This is critical to prove the consumer's purchase and establish the timeline of the complaint.
    • If the product was purchased online, an email confirmation or transaction receipt can be provided.
  • Warranty/Guarantee Card:
    • A warranty card or guarantee document can strengthen the complaint, especially if the product or service is under warranty. This proves the seller’s obligation to repair or replace the product if it malfunctions during the warranty period.
  • Communication Records:
    • Any communication between the consumer and the seller or service provider regarding the complaint is necessary. This can include:
      • Emails.
      • Text messages.
      • Call records (if any).
      • Letters or notices sent to the company.
  • Photographs/Videos of the Defective Product or Service:
    • Photographs or videos of the defective product or the service issue can serve as strong evidence. If the product is damaged or not functioning as advertised, visual proof helps establish the complaint’s validity.
  • Bank Statements or Payment Proof:
    • Bank statements or payment receipts confirming the payment made for the product or service can be essential if the issue involves non-delivery or non-provision of paid services.
    • Payment gateway receipts (for online payments) also help in confirming the transaction.
  • Copy of the Return/Refund Policy:
    • If the product or service provider has a return or refund policy, a copy of this document can support the consumer's claim if they are seeking a replacement, refund, or compensation.
  • Consumer ID/ Membership Card (if applicable):
    • For certain services, like telecom or healthcare, a consumer ID or membership card is essential to verify the consumer’s association with the service provider. This helps in identifying the account details.
  • Court Affidavit:
    • In some cases, an affidavit affirming the truthfulness of the documents and the complaint may be required. This is not always mandatory but may be requested by the Consumer Forum.

Jurisdictional Considerations

  • District Forum: The documents should be related to a local transaction or issue with a value up to ₹1 crore.
  • State Forum: When the claim amount exceeds ₹1 crore but is less than ₹10 crore, these documents must be submitted to the respective State Consumer Forum.
  • National Forum: For claims above ₹10 crore, the complaint is escalated to the National Consumer Forum along with all the required documentation.

Example

Suppose a consumer buys a washing machine for ₹30,000, and it breaks down after just a few months, despite being within the warranty period. After several unsuccessful attempts to get a resolution from the retailer, the consumer decides to file a complaint with the District Consumer Forum.

Steps the consumer should take:

  • Complaint Letter: Draft a detailed letter explaining the problem with the washing machine and the failure of the retailer to resolve the issue.
  • Proof of Purchase: Attach the purchase invoice showing the date of purchase and the price.
  • Warranty Card: Provide a copy of the warranty card to show that the product was covered under warranty at the time of failure.
  • Communication Records: Include emails or call records with the retailer, highlighting the failed attempts at resolution.
  • Photographs: Attach photos or videos showing the damage or defect in the machine.
  • Bank Statement/Payment Proof: Provide a copy of the bank statement or payment receipt for the transaction.
  • Return/Refund Policy: If available, provide the return policy to demonstrate the consumer's rights.

Conclusion

The required documents are essential to ensure that a consumer's complaint is valid, supported by evidence, and can be effectively processed by the Consumer Forums. The consumer should keep all relevant documents handy before filing a complaint to avoid unnecessary delays in the legal process.
