How to file complaints against unfair business practices?

Unfair business practices, including false advertising, deceptive offers, fraud, and other unethical commercial behaviors, harm consumers and violate their rights. The Consumer Protection Act, 2019, provides a legal framework for consumers to file complaints and seek remedies through consumer forums. Understanding the correct procedure ensures effective grievance redressal and protection of consumer interests.

How To File Complaints Against Unfair Business Practices

  • 1. Identify the Nature of Unfair Practice

    Clearly identify whether the issue involves false advertising, misleading information, overcharging, denial of services, or any other deceptive or unfair trade practice.

  • 2. Collect Evidence

    Gather all supporting evidence such as advertisements, promotional materials, bills, invoices, contracts, emails, screenshots, recordings, or any other proof demonstrating the unfair practice.

  • 3. Send a Legal Notice

    Although not mandatory, it is advisable to send a legal notice to the business or service provider describing the grievance and demanding corrective action within a specified time.

  • 4. File a Complaint in the Appropriate Consumer Forum

    District Consumer Forum: For claims up to ₹1 crore.

    State Consumer Commission: For claims above ₹1 crore up to ₹10 crores.

    National Consumer Commission: For claims exceeding ₹10 crores.

  • 5. Drafting the Complaint

    Prepare a written complaint detailing the nature of the unfair practice, the parties involved, the evidence, and the relief sought such as refund, compensation, or cancellation of unfair contracts.

  • 6. Attach Supporting Documents

    Attach copies of all evidence, legal notice (if sent), bills, correspondence, and any other relevant documents.

  • 7. Payment of Fees

    Pay the prescribed filing fees based on the value of the claim. Fees vary by forum and claim amount.

  • 8. Submission and Hearing

    Submit the complaint physically or through the E-Daakhil online portal. Attend hearings as scheduled, present arguments, and provide clarifications or additional evidence as required.

  • 9. Decision and Enforcement

    If the complaint is upheld, the forum can order compensation, refund, penalty on the business, or any other suitable relief. The decision is binding and enforceable.

Example

Scenario:

A consumer purchases a smartphone advertised as having 128GB storage. After purchase, it is discovered that the device only has 64GB storage. The seller refuses to refund or replace the product.

Steps the consumer should take:

  • Collect the advertisement and purchase receipt as evidence.
  • Send a legal notice to the seller demanding correction or refund.
  • If ignored, file a complaint in the District Consumer Forum citing false advertising and unfair trade practice.
  • Attach all evidence and specify the relief sought.
  • Attend hearings and present the case.
  • Obtain an order for refund or replacement along with compensation for mental agony.
