How to file complaints for defective electrical goods?

Answer By law4u team

Electrical goods like fans, refrigerators, washing machines, and other appliances are essential in daily life. Defective electrical products can cause inconvenience, financial loss, or even pose safety hazards like electric shocks or fire. The Consumer Protection Act, 2019 provides consumers the right to file complaints and claim compensation for faulty electrical goods. Understanding the complaint process helps consumers protect their rights effectively.

Procedure to File Complaints for Defective Electrical Goods

1. Identify the Defect

  • Check for malfunctioning, unusual noise, overheating, or complete failure of the electrical product.
  • Verify if the defect falls within the warranty period or manufacturer’s guarantee.

2. Gather Evidence

  • Keep the defective product and its original packaging safe.
  • Retain the purchase receipt, warranty card, and user manual.
  • Take clear photographs or videos showing the defect or damage.
  • Maintain records of communication with the seller or manufacturer regarding the issue.

3. Contact the Seller or Manufacturer

  • Report the defect in writing (email or letter) requesting repair, replacement, or refund as per warranty terms.
  • Note the response or refusal from the seller/manufacturer.

4. File a Complaint in Consumer Forum

  • If the seller/manufacturer fails to resolve the issue, draft a formal complaint detailing the defect, attempts to resolve, and relief sought (repair, replacement, refund, compensation).
  • Attach all evidence including bills, warranty, photographs, and communication records.
  • Submit the complaint to the District, State, or National Consumer Disputes Redressal Commission based on the value of goods and compensation claimed.

5. Follow-Up and Hearing

  • Attend hearings scheduled by the consumer forum.
  • Present your case clearly and provide all relevant evidence.
  • The forum may order repair, replacement, refund, or compensation based on the facts.

Important Documents to Attach

  • Original purchase invoice or receipt.
  • Warranty card and product manual.
  • Photographic evidence of defects.
  • Correspondence with seller or manufacturer.
  • Identity proof of the complainant.

Consumer Tips

  • Always buy electrical goods from authorized dealers or reputed sellers.
  • Check warranty terms carefully at the time of purchase.
  • Don’t ignore minor defects; report them early.
  • Retain all documents safely until product life ends.
  • Be aware of safety recalls and product advisories.

Example

  • A consumer buys a washing machine which stops working within 3 months:
  • Contacts the seller requesting repair under warranty, but the seller refuses.
  • Collects all purchase and communication records.
  • Files a complaint in the District Consumer Forum demanding replacement and compensation for inconvenience.
  • The forum orders the seller to replace the washing machine and pay compensation.

Conclusion

Consumers have the right to seek redressal for defective electrical goods under the Consumer Protection Act 2019. By identifying defects promptly, maintaining proper documentation, and following the complaint procedure, consumers can ensure their grievances are addressed effectively and receive appropriate compensation or product replacement.
