Can consumer complaints be filed against telecommunication companies?

Answer By law4u team

Telecommunication services are an integral part of modern life, enabling communication, online access, banking, and more. However, issues such as call drops, poor network coverage, data speed problems, overcharging, and service delays are common grievances faced by consumers. Under the Consumer Protection Act, 2019, and with regulatory oversight from the Telecom Regulatory Authority of India (TRAI), consumers are entitled to raise complaints and seek appropriate redressal through defined legal channels.

Common Complaints Against Telecom Companies

  • Frequent call drops and poor signal reception
  • Slow or unstable internet connection
  • Incorrect billing and hidden charges
  • Denial of committed services or benefits
  • Automatic activation of paid services without consent
  • Delayed disconnection of services upon request
  • Unresolved porting issues between networks
  • Unsolicited marketing calls or spam messages

Step-by-Step Procedure to File Complaints

  • Lodge a Complaint with Customer Care (Level 1):
    • Contact your telecom service provider’s customer care number or file a complaint through their official app or website.
    • Note the complaint or service request number for future reference.
    • Wait for 3 to 7 working days for resolution.
  • Escalate to the Nodal Officer (Level 2):
    • If unresolved, escalate to the nodal officer of your service provider.
    • Find nodal officer details on the operator’s website by region.
    • Send an email or registered letter mentioning the original complaint number.
  • Appeal to the Appellate Authority (Level 3):
    • If the nodal officer fails to resolve the issue within 10 days, approach the telecom operator’s Appellate Authority.
    • Fill out the appeal form (available on the provider’s website).
    • Submit all supporting communication and complaint references.
  • Approach TRAI or TDSAT:
    • TRAI does not resolve individual complaints directly but can be informed of policy violations or systemic issues.
    • Unresolved disputes can be taken to the Telecom Disputes Settlement and Appellate Tribunal (TDSAT).
  • File a Complaint with the Consumer Forum:
    • For serious or unresolved grievances involving financial or emotional harm, file a complaint under the Consumer Protection Act, 2019.
    • Choose the correct forum based on your claim:
      • District Commission: Up to ₹1 crore
      • State Commission: ₹1 crore to ₹10 crores
      • National Commission: Above ₹10 crores
    • Attach all supporting documents such as bills, correspondence, and service denial proof.

Remedies Available to Consumers

  • Refund of excess charges or wrongly billed amounts
  • Compensation for poor or interrupted services
  • Removal or discontinuation of unauthorized services
  • Improvement of network or service quality
  • Reconnection or activation of services within timelines
  • Penalty to service provider for non-compliance

Required Documents

  • Bill copies or payment receipts
  • Complaint number and correspondence with customer care
  • Screenshots of messages, call logs, or app records
  • Proof of financial or service-related loss
  • Identity and service details

Consumer Tips

  • Always keep a written or digital record of complaints and responses
  • Use registered post or email for important communication
  • Keep complaint IDs safe for future use
  • Know your rights under the Consumer Protection Act
  • File your complaint within the limitation period (generally 2 years from the cause of action)

Example

  • A consumer subscribed to a 100 GB monthly data plan from a telecom provider.
  • Only 30 GB was credited monthly despite multiple complaints.
  • The consumer escalated the matter to the nodal officer and then to the appellate authority, but no resolution was offered.
  • The consumer filed a case in the District Consumer Forum with all communication, bills, and data usage logs.
  • The forum ruled in favor of the consumer, ordering a refund of the excess amount charged and ₹7,500 compensation for inconvenience and mental harassment.
