Can a consumer approach consumer courts for faulty banking services?

Answer By law4u team

Banks and financial institutions are service providers under the Consumer Protection Act, 2019. Consumers using banking services - such as savings accounts, loans, credit cards, net banking, or ATM services have the right to expect proper service. However, when banks fail to deliver due services or act negligently, such as deducting wrong amounts, refusing refunds, delaying transactions, or mishandling accounts, consumers have the right to approach the Consumer Courts for redressal and compensation.

Common Faults in Banking Services

  • Unauthorized or fraudulent transactions
  • ATM dispensing wrong amount or failing to dispense cash
  • Delay in crediting deposits or clearing cheques
  • Non-issuance or delay in issuing account statements or passbooks
  • Excessive or hidden charges without consent
  • Non-processing of legitimate loans or transactions
  • Incorrect credit card billing
  • Denial of online banking or mobile banking access
  • Delay or failure in reversing disputed transactions

Legal Backing for Filing Complaints

  • The Consumer Protection Act, 2019 defines a consumer as any person who hires or avails of any service for consideration.
  • Banking services fall under the definition of services in the Act.
  • Service deficiency, negligence, unfair trade practices, or non-compliance with RBI norms are valid grounds for consumer complaints.

Procedure to File Complaint Against a Bank in Consumer Court

  1. Attempt Internal Resolution First
    • Lodge a written complaint with the bank’s branch manager or via email to customer care.
    • Banks are required to respond within 30 days as per RBI guidelines.
    • Collect a written response or acknowledgement.
  2. Escalate to the Bank’s Grievance Redressal Officer
    • If no response is received or the issue is unresolved, escalate to the bank’s nodal officer or grievance officer.
    • Every bank provides contact details of grievance officers on its website.
  3. Approach the Banking Ombudsman (Optional Step)
    • File a complaint with the Banking Ombudsman appointed by the Reserve Bank of India (RBI).
    • This step is optional but may result in faster resolution without legal cost.
    • If not satisfied with the Ombudsman’s decision, consumers can proceed to the consumer forum.
  4. File Complaint in the Appropriate Consumer Commission
    • Based on the claim amount and compensation sought, approach:
      • District Commission – for claims up to ₹1 crore
      • State Commission – for ₹1 crore to ₹10 crore
      • National Commission – above ₹10 crore
    • Prepare a written complaint detailing the nature of deficiency, loss suffered, relief sought, and all supporting documents.
  5. Submit Supporting Documents
    • Bank statements, emails, complaint letters, transaction slips, account records
    • Any written replies received from the bank
    • Proof of financial loss or inconvenience caused
    • Copy of complaint to ombudsman (if any)
  6. Attend Proceedings and Present Case
    • After filing, the court issues notice to the bank.
    • You will need to attend hearings and present facts with evidence.
    • Orders may include refund, compensation, and penalty on the bank.

Reliefs and Remedies Available to Consumers

  • Refund of the wrongly debited or blocked amount
  • Compensation for financial loss, mental agony, and harassment
  • Penalties on the bank for negligence or unfair practices
  • Directions to correct or update account-related errors
  • Reversal of unauthorized charges or fees

Important Notes

  • Complaints must be filed within 2 years from the date of cause of action.
  • Legal assistance is not mandatory but can help in complex banking disputes.
  • You can also file complaints online through the E-Daakhil Portal for consumer forums.

Example

  • A consumer's account is debited with ₹15,000 due to an unauthorized ATM transaction.
  • The consumer informs the bank and requests reversal.
  • The bank delays resolution for over a month and denies refund, claiming no fault.
  • The consumer files a complaint with the Banking Ombudsman, but the case is dismissed due to insufficient action by the bank.
  • The consumer then files a complaint in the District Consumer Commission, attaching bank statements, complaint emails, and ATM logs.
  • The forum orders the bank to refund the amount and pay ₹10,000 as compensation for mental harassment and legal costs.
