The mediation process begins when the consumer approaches a consumer forum or regulatory authority (like TRAI or the Central Consumer Protection Authority (CCPA)) and expresses their desire to resolve the dispute through mediation. Both parties are informed about the opportunity to engage in mediation before formal litigation takes place.

2. Selection of a Mediator

Once the parties agree to mediation, a neutral mediator is selected. The mediator may be a professional trained in conflict resolution, or in some cases, a consumer forum official or representative. The role of the mediator is to facilitate communication between the parties and guide them toward a resolution. Mediators do not make decisions for the parties but help them come to an agreement on their own.

3. Mediation Session

The mediation session typically takes place in a neutral setting. Both parties are invited to present their side of the dispute, explain their concerns, and highlight their expectations for a resolution. The mediator listens to both sides, identifies the issues in the dispute, and helps facilitate constructive discussions to explore possible solutions.

4. Negotiation

The core of mediation is negotiation. The mediator will encourage the consumer and service provider to negotiate terms that are acceptable to both parties. This could involve:

  • Service credits or refunds for poor service.
  • Agreement to fix the defect or provide an alternative product.

5. Settlement or Impasse

If the parties reach a mutually agreeable solution, the mediator will record the settlement in writing, and it can be enforced like a legal contract. This written agreement may be filed with the consumer forum, which will issue a consent order to make it legally binding.

If no agreement is reached, the mediation process concludes, and the consumer can still pursue formal legal proceedings in a consumer forum or court.
