What is the format of a consumer complaint?

Answer By law4u team

Filing a consumer complaint is an essential step for resolving disputes under the Consumer Protection Act, 2019. The complaint must follow a specific format to ensure that the relevant details are presented clearly and in a manner that facilitates quick resolution. Whether the complaint is filed with a consumer forum, TRAI, or CCPA, the format should include all necessary information about the nature of the grievance, the parties involved, and supporting evidence.

A well-structured complaint increases the chances of getting a prompt and favorable resolution. Here’s a comprehensive guide to the format of a consumer complaint.

Format of a Consumer Complaint

1. Heading

Start with the heading Complaint or Consumer Complaint at the top of the page. This makes the purpose of the document clear.

2. Complainant’s Details

Include the details of the complainant (consumer) in the following order:

  • Name: Full name of the complainant.
  • Address: Complete residential address.
  • Phone Number: Contact number.
  • Email Address: Email address (if applicable).
  • Occupation: Profession or occupation.
  • ID Proof: Mention any ID proof submitted (e.g., Aadhaar, Passport).

Example:
Name: Rajesh Kumar
Address: 123, Gandhi Nagar, Delhi-110001
Phone Number: +91 9876543210
Email: [email protected]
Occupation: Teacher

3. Details of the Opposite Party (Service Provider or Seller)

This section includes the details of the opposite party (i.e., the business, seller, or service provider) against whom the complaint is made.

  • Name of the Business: Full legal name of the company, service provider, or seller.
  • Registered Address: The official address of the business.
  • Contact Details: Phone number and email address.
  • Name of the Responsible Person: If applicable, mention the name of the person (like the manager or CEO) responsible for customer service or complaints.

Example:
Name: XYZ Telecom Ltd.
Address: 456, Sector 10, Gurgaon-122001
Phone Number: +91 8005551234
Email: [email protected]

4. Nature of the Complaint (The Issue)

Describe the issue in clear and concise terms. Include the following:

  • Description of the product or service: What was purchased or the service received (e.g., mobile phone, internet plan).
  • Details of the complaint: Explain the nature of the problem, such as defects, substandard service, poor quality, wrong billing, non-delivery, etc.
  • Date of the incident: Mention the date when the issue occurred or the service was rendered.

Example:
On 15th July 2023, I purchased a XYZ mobile phone from XYZ Telecom, which was supposed to offer 5G connectivity. However, the phone does not support 5G, and I have received multiple error messages when trying to use the 5G service.

5. Steps Taken Before Filing the Complaint

Mention if you’ve already taken any steps to resolve the issue before approaching the forum. This may include:

  • Contacting the service provider: Provide details of communication with the company (dates, email responses, phone calls).
  • Escalation: If the issue was escalated to a higher authority or department, mention that.
  • Written Complaint: If you submitted a written complaint to the service provider or seller, include the date.

Example:
I contacted XYZ Telecom's customer support on 16th July 2023 and was informed that they would look into the issue, but no resolution has been provided so far. I also emailed them on 17th July 2023, but received no response.

6. Relief Sought

Clearly state the relief you are seeking or the compensation you desire. This could include:

  • Refund for defective products or services.
  • Replacement of a faulty item.
  • Compensation for financial loss, mental agony, or any other hardship caused.
  • Corrective action to resolve the issue.

Example:
I request a full refund for the defective mobile phone purchased on 15th July 2023, or a replacement of the phone with a model that supports 5G connectivity as advertised.

7. Jurisdiction

State the jurisdiction under which you are filing the complaint. This refers to the specific consumer forum or authority where the complaint is being filed:

  • District Consumer Forum, State Consumer Commission, or National Consumer Commission depending on the claim amount.
  • If filing directly with TRAI, mention it here.

Example:
The complaint is being filed in the District Consumer Forum, Gurgaon, as the claim amount is below ₹20 lakhs.

8. Documents Attached

List the documents attached to support your complaint. These could include:

  • Proof of Purchase: Receipts, invoices, or contracts.
  • Correspondence with the service provider: Emails, letters, or call records.
  • Photographs or Videos: If applicable, to support the claim (e.g., defective product images).
  • ID Proof: Copy of ID proof for identity verification.

Example:
Copy of the purchase invoice.
Email correspondence with customer support.
Photograph of the defective mobile phone.
Copy of Aadhaar Card for identity proof.

9. Signature and Date

Conclude the complaint with your signature and the date of filing.

Example:
Signature: [Your Signature]
Date: [DD/MM/YYYY]

Conclusion

By following the proper format for filing a consumer complaint, you can ensure that your grievance is communicated effectively and meets the necessary legal requirements. This format helps ensure that all relevant details are presented in an organized manner, increasing the chances of getting a timely resolution to your issue. Whether you're filing with a consumer forum, TRAI, or another authority, a well-structured complaint will help move the process forward.
