Appeal Procedure from the District Consumer Forum to the State Commission

  • Who Can File an Appeal

  • Time Limit for Filing an Appeal
  • The appeal must be filed within 45 days from the date of the receipt of the order passed by the District Forum. If the appellant fails to file within this period, they can request an extension. However, the State Commission may allow the appeal beyond 45 days, but not more than 30 days after the expiry of the initial period, if there are valid reasons for the delay.

    • The appellant needs to file a written appeal, outlining the grounds for the appeal.
    • The appeal must be submitted along with the prescribed fee (which is typically a percentage of the compensation or disputed amount).

  • Decision and Enforcement
  • After hearing both parties, the State Commission will pass its order. If either party is dissatisfied with the decision of the State Commission, they can further appeal to the National Consumer Disputes Redressal Commission within 30 days.
