How to file a complaint against a faulty appliance under warranty?

Appliances like refrigerators, washing machines, or microwaves are often purchased with a warranty, ensuring that they are free from defects for a certain period after purchase. However, if the appliance malfunctions or does not perform as advertised within the warranty period, consumers have the right to file a complaint and seek redressal. The Consumer Protection Act, 2019 safeguards consumer rights in such cases, allowing consumers to demand repairs, replacements, or refunds for faulty products under warranty.

Steps to File a Complaint Against a Faulty Appliance Under Warranty

  1. Review the Warranty Terms:

    The first step is to carefully review the warranty that came with the appliance. The warranty document usually outlines:

    • The duration of the warranty.
    • Coverage details (e.g., what defects or issues are covered).
    • Exclusions (e.g., damages caused by improper use or natural disasters).
    • The process for making a warranty claim.

    Most manufacturers offer a limited warranty for defects in materials or workmanship, but conditions apply.

  2. Contact the Seller or Manufacturer:

    Once you identify that the appliance is faulty and within the warranty period, contact the seller or the manufacturer’s customer service.

    Inform them about the problem with the appliance and mention that it is within the warranty period.

    The manufacturer or seller may ask for:

    • Purchase proof (invoice or receipt).
    • Product details (model, serial number).
    • Description of the defect or issue.
    • Photographs or videos showing the defect (if applicable).

    Some manufacturers may offer repair services directly, while others might advise you to take the appliance to an authorized service center.

  3. Request Repair, Replacement, or Refund:

  4. Escalate the Issue to the Consumer Forum:

    If the seller or manufacturer refuses to honor the warranty, or if they fail to provide a satisfactory resolution, you can file a complaint with the Consumer Forum.

    Consumer Forums exist at the District, State, and National levels, depending on the value of the claim.

    • District Forum: For claims up to ₹1 crore.
    • State Commission: For claims between ₹1 crore and ₹10 crore.
    • National Commission: For claims over ₹10 crore.

    To file a complaint, you will need:

    • The purchase receipt and proof of warranty.
    • Any communication with the seller or manufacturer.
    • Details of the defect and the steps you’ve taken to resolve the issue.
    • A formal request for compensation, replacement, or repair.
  5. Prepare the Necessary Documentation:

    When filing a complaint, ensure that you have all required documents, such as:

    • Proof of purchase (invoice or receipt).
    • Warranty card (if applicable).
    • Service request or complaint receipts from the manufacturer or seller.
    • Written correspondence with the company regarding the issue.
    • Photographs or video recordings of the appliance's defect.

    These documents will help substantiate your claim and support your case.

  6. File the Complaint:

    You can file a complaint with the Consumer Forum either online or offline, depending on the procedure for the forum you are approaching.

    The complaint should include:

    • Personal details (name, address, etc.).
    • The details of the faulty appliance.
    • A clear description of the defect and any steps taken to resolve the issue.
    • A request for the remedy sought (repair, replacement, refund, or compensation).

Remedies Available for Faulty Appliances Under Warranty

  • Repair of the Faulty Appliance: If the appliance can be repaired, the consumer can request that the manufacturer or seller fixes the issue without charging any additional fees.
  • Replacement of the Appliance: If the appliance cannot be repaired or the defect is recurrent, the consumer can demand a replacement of the appliance with a similar one or an equivalent model.
  • Refund for the Appliance: If the product is fundamentally defective and cannot be repaired or replaced, the consumer may be entitled to a full refund of the purchase price.
  • Compensation for Damages: If the appliance malfunctioned and caused losses or damages (such as property damage or loss of food in a faulty refrigerator), the consumer can seek compensation for the losses.
  • Legal Actions for Unfair Practices: If the seller or manufacturer fails to honor the warranty or engages in unfair trade practices (such as misleading advertisements), the consumer can request that the Consumer Forum impose penalties on the company.

Case: A consumer buys a washing machine with a two-year warranty. After 10 months, the machine starts making unusual noises and fails to operate correctly. The consumer contacts the manufacturer’s customer service, who directs them to a service center. However, the service center reports that the issue cannot be fixed easily, and the company refuses to replace the appliance.

Steps Taken:

  • The consumer reviews the warranty document and confirms the machine is still under warranty.
  • The consumer contacts the manufacturer and provides the purchase receipt, the warranty card, and photos of the faulty machine.
  • After several attempts to get a resolution, the consumer files a complaint with the District Consumer Forum, requesting a replacement or refund.
  • The manufacturer fails to resolve the issue, so the Consumer Forum schedules a hearing.
