How to file a complaint against food poisoning in restaurants?

  • File a Complaint with Local Health Authorities

    You can file a complaint with the local health department or Food Safety and Standards Authority of India (FSSAI):

    • Food Safety Complaints: FSSAI regulates food safety and hygiene standards, so consumers can report cases of food contamination, foodborne illness, or unsafe practices.

  • Approach the Consumer Forum

    If the restaurant refuses to compensate for the food poisoning or the health department does not resolve the issue satisfactorily, you can approach the Consumer Forum or Consumer Court.

      • District Consumer Forum: For claims up to ₹1 crore.
      • State Consumer Commission: For claims between ₹1 crore and ₹10 crore.
      • National Consumer Commission: For claims exceeding ₹10 crore.
    • Complaint Details: Provide detailed information about the food poisoning incident, including the restaurant details, the food consumed, medical reports, communication with the restaurant, and the expenses incurred due to the foodborne illness.
  • Claim Compensation for Damages

    You can seek compensation for the following damages:

    • Medical Expenses: You are entitled to claim compensation for any medical treatment you required as a result of the food poisoning.
    • Mental Distress and Inconvenience: You can also seek compensation for any emotional distress caused by the illness, particularly if it led to significant physical discomfort or missed work.

  • File a Complaint: If the restaurant refuses to address the matter, the consumer can file a complaint with the local health authority and FSSAI, as well as approach the consumer court for compensation.
