How to file a complaint against online frauds in India?

Online fraud has become a significant concern in India, with the rise of phishing attacks, fraudulent e-commerce transactions, identity theft, and banking frauds. The Consumer Protection Act, 2019 provides legal mechanisms to protect consumers against such fraudulent activities. Consumers who fall victim to online fraud have several options for reporting the incident, seeking redressal, and securing compensation. It's crucial for consumers to be aware of the proper steps to take when they encounter fraud online and how to safeguard their financial and personal information from cybercriminals.

Steps to File a Complaint Against Online Frauds in India:

  1. Report to the Concerned Service Provider (E-commerce Platform, Bank, etc.)
    • E-commerce Fraud: If the fraud occurred through an e-commerce platform (like Amazon, Flipkart, etc.), immediately contact the customer support of the platform and explain the situation. If you have been charged for goods or services not received, request a refund or order cancellation.
    • Banking Fraud: If you suspect a banking fraud (unauthorized transactions or debit/credit card misuse), immediately contact your bank’s fraud department or use their online banking support. Most banks have a 24/7 helpline dedicated to resolving such issues.
    • File a Dispute: Banks and e-commerce platforms generally offer dispute resolution mechanisms that may involve verifying transactions, providing compensation, or reversing fraudulent charges.
  2. File a Complaint with the National Consumer Helpline (NCH)
    • The National Consumer Helpline (NCH), managed by the Ministry of Consumer Affairs, Government of India, allows consumers to file complaints regarding fraudulent activities under the Consumer Protection Act, 2019.
    • How to File: You can file a complaint through the NCH portal, mobile app, or by calling the toll-free number (1800-11-4000). Provide all details of the fraudulent transaction, including the product details, transaction ID, and the nature of the fraud.
    • Consumer Complaint Form: Fill out the form with the relevant information and attach supporting documents, such as receipts, screenshots, or any correspondence with the fraudster.
  3. Report to the Cyber Crime Cell (CCS)
    • Cybercrime Reporting: If the fraud involves phishing attacks, identity theft, or other online scams, you can report it to the Cyber Crime Cell of your local police department or the National Cyber Crime Reporting Portal (cybercrime.gov.in).
    • National Cyber Crime Reporting Portal: The cybercrime.gov.in portal is an initiative by the Government of India where individuals can report cybercrimes including online fraud, scams, and identity theft.
    • How to File: You will need to provide personal details, details of the incident, and any evidence of the fraud (screenshots, transaction records, etc.).
    • Complaint Acknowledgement: Upon filing the complaint, the authorities may provide an acknowledgment receipt and start an investigation into the matter.
  4. Approach the Consumer Forum or Consumer Court
    • If the issue is not resolved by the service provider, bank, or NCH, you can file a complaint in the Consumer Forum or Consumer Court under the Consumer Protection Act, 2019.
    • District Consumer Forum: For complaints involving amounts up to ₹1 crore.
    • State Consumer Commission: For complaints with claims between ₹1 crore and ₹10 crore.
    • National Consumer Commission: For complaints exceeding ₹10 crore.
  5. File a Complaint with the Reserve Bank of India (RBI) for Banking Fraud
    • The Reserve Bank of India (RBI) provides a Complaint Management System (CMS) for filing complaints against banking frauds.
    • How to File: Visit the RBI CMS portal and fill in the necessary details related to fraudulent transactions. If you have been defrauded by a banking or financial institution, the RBI will investigate the matter and intervene where required.
    • RBI’s Role: The RBI can take corrective action against the bank or financial institution if they have not followed proper procedures or if consumer protection norms were violated.
  6. Report to the E-commerce Consumer Protection Platforms
    • In addition to filing complaints with NCH and Consumer Courts, you can also report fraud on specific consumer forums dedicated to e-commerce transactions, like eBay, Amazon, Flipkart, or Paytm.
    • These platforms have their own customer service teams to handle fraud-related complaints and may offer quick resolutions, including refunds or product replacements.
  7. Inform the Fraudulent Website or Service Provider
    • In cases where the fraud originated from a specific website or social media platform, inform the website or service provider so they can take down the fraudulent content or report the fraud to the relevant authorities.

Legal Remedies Available Under the Consumer Protection Act, 2019:

  • Right to Seek Redressal: Under the Consumer Protection Act, consumers who have been defrauded are entitled to seek redressal for the financial loss caused by fraudulent transactions. Consumers can file complaints with Consumer Forums for compensation and corrective measures.
  • Compensation for Financial Loss: Consumers may claim compensation for the monetary loss, mental distress, or inconvenience caused by online fraud. This could include the amount defrauded plus any additional damages for emotional or financial suffering.
  • Penalties for Fraudulent Entities: If the fraud was committed by a business, service provider, or e-commerce platform that has violated consumer laws, the court can impose penalties or fines on the fraudulent entity.

How to Protect Yourself from Online Frauds:

  • Avoid Sharing Sensitive Information: Never share bank account, card details, PIN, or OTP over email or text messages. Be cautious about unsolicited messages or emails asking for personal information.
  • Use Secure Payment Methods: Prefer secure payment gateways or digital wallets that offer protection against fraudulent transactions. Ensure the website has SSL encryption (look for https in the URL).
  • Enable Two-Factor Authentication (2FA): Activate 2FA on your bank accounts and e-commerce platforms to add an extra layer of security.
  • Regularly Monitor Bank Statements: Keep track of your banking transactions and report any suspicious activity immediately.
  • Be Aware of Phishing: Be cautious of phishing emails that ask for login details or personal information. Always verify the sender’s email address before clicking on links.

Example:

A consumer received an email claiming to be from Amazon, offering a free gift card in exchange for completing a survey. After clicking on the link and providing personal details, the consumer found that their bank account was charged without authorization.

Steps the Consumer Should Take:

  • Contact the Bank: Immediately report the fraudulent transaction to the bank to block the account and reverse the charge.
  • File a Complaint with the Cybercrime Portal: Report the phishing attempt and fraudulent transaction on cybercrime.gov.in.
  • File a Complaint with the NCH: Contact the National Consumer Helpline for assistance in filing a consumer complaint.
  • File a Case in Consumer Forum: If no resolution is achieved, file a consumer complaint in the District Consumer Forum for compensation.
