What are the rights of consumers under the Consumer Protection Act 2019?

Answer By law4u team

The Consumer Protection Act, 2019 is a robust piece of legislation that safeguards the rights of consumers in India. The Act provides comprehensive protection against defective products, substandard services, and unfair trade practices by businesses. With the evolution of e-commerce and digital platforms, the Act also aims to protect consumers from online fraud, misleading advertisements, and unsafe products sold in the market. The Act empowers consumers to seek compensation, redressal, and legal remedies in case of violations of their rights.

Consumer Rights Under the Consumer Protection Act, 2019:

  1. Right to Protection Against Defective Goods and Services:
    • Consumers have the right to safe and quality products and services. If a product is defective or a service is substandard, consumers are entitled to:
      • Replacement, repair, or refund for defective goods.
      • Compensation for poor or deficient services.
      • Guarantee of products, as per the terms of the warranty.
    • Right to Fair Treatment: Consumers have the right to not be deceived by misleading advertisements or hidden terms in service contracts.
  2. Right to Be Informed:
    • Consumers have the right to clear and accurate information about products and services. This includes:
      • Right to Full Disclosure: Clear labeling and price transparency to prevent deceptive practices.
      • Information on Ingredients or Components: Full information about the product’s origin, manufacturing process, and potential health impacts.
      • Right to Know the Terms of Sale: Clear terms about warranties, delivery charges, and any hidden costs associated with the transaction.
  3. Right to Choose:
    • Consumers have the right to choose products and services from a wide range of options at competitive prices without the pressure of deceptive marketing or monopolies.
    • This right protects consumers from unfair trade practices like price-fixing or being forced into exclusive contracts.
  4. Right to Be Heard:
    • Consumers have the right to voice their concerns, complaints, and grievances regarding goods and services they have purchased. This right is protected through mechanisms like:
      • Consumer forums at the district, state, and national levels.
      • Online complaint portals provided by the National Consumer Helpline (NCH) and State Consumer Helplines.
  5. Right to Seek Redressal:
    • Consumers have the right to file complaints and seek compensation if they have faced problems like:
      • Defective products.
      • Substandard services.
      • Misleading advertisements.
    • Consumer courts and consumer forums at various levels (District, State, and National) provide accessible means for consumers to seek redressal.
  6. Right to Consumer Education:
    • Consumers have the right to be educated about their rights and how to exercise them.
    • This is essential to help consumers make informed decisions, whether it’s buying a product, seeking services, or filing complaints against unfair practices.
    • Consumer Protection Awareness Programs and online resources provide consumers with tools to educate themselves on product quality, warranties, and consumer laws.
  7. Right to Protection from Unfair Trade Practices:
    • Consumers have the right to be free from practices like:
      • False advertising and misleading representations.
      • Unfair contract terms that bind the consumer to exploitative conditions.
      • Bait-and-switch tactics where businesses advertise low-cost goods but substitute them with higher-priced items.
    • Under the Act, misleading advertisements and deceptive marketing are prohibited, and consumers can file complaints if they fall victim to such practices.

How Consumers Can Enforce Their Rights:

  1. Filing a Complaint with Consumer Forums:
    • Consumers can approach the District Consumer Forum if the value of the goods or services is less than ₹1 crore, the State Consumer Commission for claims up to ₹10 crore, and the National Consumer Commission for claims exceeding ₹10 crore.
    • Documents Required:
      • Proof of purchase (receipt, invoice).
      • Complaint letter explaining the grievance.
      • Evidence like photographs, emails, videos, etc., supporting the claim.
    • Possible Outcomes:
      • Compensation for loss or inconvenience.
      • Replacement or repair of defective products.
      • Penalties on the business for unfair practices.
  2. Approaching the Consumer Helplines:
    • The National Consumer Helpline (NCH) allows consumers to lodge complaints online or via phone. The helpline also provides guidance on how to proceed with legal recourse if needed.
  3. Online Complaint Redressal Mechanisms:
    • The Consumer Protection Act, 2019 introduces a mechanism for filing online complaints. Consumers can visit official portals like the National Consumer Disputes Redressal Commission (NCDRC) to file complaints, track the progress of their cases, and receive electronic updates on the status of their complaints.
  4. Filing Complaints Against E-Commerce and Online Transactions:
    • Under the Act, consumers who face issues with online transactions or e-commerce platforms can file complaints directly with the Consumer Commission or the relevant regulatory authority like the Ministry of Consumer Affairs.

Example:

A consumer purchases a washing machine from an online platform, but the product is faulty. Despite several attempts to contact customer support, the issue remains unresolved, and the consumer is not provided with a refund or replacement.

Steps the Consumer Should Take:

  • Contact the seller: Request a refund or replacement.
  • File an official complaint: Keep records of all communications.
  • File a complaint with the District Consumer Forum: Attach the invoice, communication records, and photos of the faulty product.
  • The consumer may claim compensation for the inconvenience caused by the defective product.

Possible Compensation Under the Act:

  1. Monetary Compensation: For loss, injury, or inconvenience caused by defective goods or substandard services.
  2. Refund or Replacement: When a product fails to meet promised quality or specifications.
  3. Penalties: On businesses found guilty of misleading practices, deceptive advertising, or failing to provide quality goods and services.

Consumer Safety Tips:

  • Always Retain Proof of Purchase: Keep receipts, invoices, and warranties for all goods and services purchased.
  • Review Terms and Conditions: Before buying, ensure you understand the terms of service, warranty, and return policy.
  • Report Issues Promptly: If you face a problem with a product or service, report it to the company or service provider immediately. If they don’t respond, escalate the complaint.
  • Educate Yourself: Stay informed about your rights under the Consumer Protection Act to avoid being misled by deceptive practices or substandard services.
