How to file complaints for defective electrical goods?

Electrical goods, such as refrigerators, washing machines, televisions, microwaves, and air conditioners, are essential household items. However, when these products are defective, they can cause inconvenience, financial losses, and even pose safety risks. Under the Consumer Protection Act, 2019, consumers are empowered to file complaints and seek remedies like repair, replacement, refunds, and compensation for faulty electrical appliances. If a product is under warranty or guarantee, the manufacturer or seller is obligated to provide a solution.

Steps to File Complaints for Defective Electrical Goods:

  • Identify the Defect

Examine the product to determine the defect or malfunction. Common defects in electrical goods include:

  • Failure to power on or turn off.
  • Overheating or electric shock risks.
  • Faulty wiring or components.
  • Performance issues, such as poor cooling (for ACs, refrigerators) or inconsistent heat (for microwaves).

Document the defect by taking photos or videos that clearly show the problem, and keep the product receipt or invoice for proof of purchase.

  • Contact the Seller or Manufacturer

Notify the seller or manufacturer about the defect immediately. Many manufacturers offer customer support services for troubleshooting and warranty claims.

Request the seller or manufacturer for repair, replacement, or refund based on the terms of the warranty or guarantee.

Ensure that you record all communication with the seller, including emails, phone calls, and letters.

  • Check Warranty or Guarantee Terms

Review the warranty or guarantee provided with the electrical goods. Many electrical appliances come with a one-year warranty or a service guarantee.

If the product is still within the warranty period, the manufacturer is generally obligated to:

  • Repair the faulty appliance free of charge.
  • Replace it if the defect is unrepairable.
  • Offer a refund for the defective product.
  • File a Formal Complaint with the Consumer Forum

If the seller or manufacturer refuses to resolve the issue or offers an unsatisfactory solution, you can file a complaint with the consumer forum under the Consumer Protection Act, 2019.

Where to file:

  • District Consumer Forum: If the value of the goods or compensation claim is below ₹1 crore.
  • State Consumer Commission: For claims between ₹1 crore and ₹10 crore.
  • National Consumer Commission: For claims above ₹10 crore.

Documents Required to File a Complaint:

  • Complaint letter clearly describing the defect and the action taken.
  • Purchase invoice or receipt.
  • Warranty card (if applicable).
  • Proof of communication with the seller or manufacturer, such as emails or letters.
  • Photos/videos showing the defect.
  • Repair records or service reports, if any.
  • Consumer Forums and Their Role

District Consumer Forum will handle the complaint for faulty electrical goods if the claim value is less than ₹1 crore. They can:

  • Order repair, replacement, or refund.
  • Compensate for the inconvenience caused by the defective product.

State Consumer Commission and National Consumer Commission will handle cases involving higher-value claims, offering similar remedies but in more complex cases.

  • Online Platforms for Filing Complaints

Many e-commerce platforms like Amazon, Flipkart, etc., have mechanisms to handle complaints about defective goods bought online. These platforms often have a refund or return policy within a specific period (usually 7-30 days).

Consumer helplines: Websites like ConsumerComplaints.in and National Consumer Helpline (NCH) allow consumers to submit their complaints online for further assistance.

Legal Remedies for Defective Electrical Goods:

  • Repair

If the electrical goods are still under warranty, consumers can request the manufacturer or seller to repair the defective product at no additional cost.

The repair should be completed within a reasonable time frame.

  • Replacement

If the defect cannot be repaired, consumers can demand replacement of the faulty product with a new, functioning product of the same make and model.

  • Refund

If the defect is substantial and the product cannot be repaired or replaced, consumers may request a refund for the full amount they paid for the electrical goods.

Refunds are generally expected within the terms of the warranty or return policy.

  • Monetary Compensation

Consumers are also entitled to compensation for:

  • Financial losses caused by the defective electrical goods (e.g., property damage, medical expenses in case of electrical shock).
  • Inconvenience, mental agony, and the time lost in dealing with the faulty product.

Example:

A consumer purchases a washing machine for ₹25,000, which starts malfunctioning after 3 months of use, displaying an error code and failing to complete the washing cycle. The consumer contacts the manufacturer's service center, but the technician is unable to fix the problem.

Steps the consumer should take:

  • Contact the manufacturer for a repair under warranty.
  • After unsuccessful repairs, demand a replacement or refund based on the warranty terms.
  • If the manufacturer refuses to replace the machine or issue a refund, the consumer should file a complaint with the District Consumer Forum for a resolution.
  • The consumer forum may order a replacement or compensation for the inconvenience caused.

Consumer Safety Tips:

  • Check Warranty Details: Always check the warranty or guarantee terms for electrical goods before purchasing.
  • Save the Proof of Purchase: Retain your invoice or receipt as evidence in case of defects.
  • Verify the Product: Inspect electrical goods immediately upon purchase for any visible damages or defects.
  • Follow Return/Repair Policies: Ensure that you are within the return or repair time frame as per the manufacturer’s or seller’s policies.
