How to Get Property Details Using RTI?

Answer By law4u team

Definition: Property details through RTI (Right to Information) refer to the process of obtaining information related to property records, ownership, and other property-related details from public authorities using the Right to Information Act, 2005.

How to Obtain Property Details Through RTI:

  1. Identify the Relevant Authority:
    • Local Authority: Determine which public authority holds the property records. This could be a municipal corporation, land revenue department, or local registrar's office.
  2. Draft the RTI Application:
    • Specify Details: Clearly state the property details you need, such as ownership records, land use, property tax details, or encumbrance status.
    • Provide Identification: Include specific details like property address, survey number, or other relevant identifiers to help the authority locate the information.
  3. Pay the Application Fee:
    • Standard Fee: Include a fee of ₹10 for the RTI application. Additional charges may apply for obtaining copies of documents or for extensive information.
    • Payment Methods: Use acceptable payment methods like cash, demand draft (DD), or Indian Postal Order (IPO). Some authorities accept electronic payments.
  4. Submit the RTI Application:
    • Submission: File the RTI application at the designated office of the Public Information Officer (PIO) of the concerned authority. You can also submit it online if the authority offers this facility.
  5. Receive Acknowledgment:
    • Acknowledgment Receipt: Ensure you receive an acknowledgment receipt or reference number for your RTI application. This will help in tracking the status of your request.
  6. Wait for the Response:
    • Response Time: The PIO is required to respond within 30 days of receiving your RTI application. The response will include the requested information or an explanation for any denial.
  7. Follow Up:
    • Follow-Up: If you do not receive a response within the stipulated time, you may file an appeal with the First Appellate Authority of the concerned department.
  8. Appeal Process:
    • First Appeal: If you are dissatisfied with the response or if no response is received, file a first appeal within 30 days from the expiry of the response time.
    • Second Appeal: If the first appeal does not resolve the issue, you can file a second appeal with the State or Central Information Commission.

Summary: To obtain property details through RTI, identify the relevant authority, draft and submit a clear RTI application with payment, receive an acknowledgment, wait for a response, and follow up or appeal if necessary. The process includes paying the application fee and potentially additional charges for copies or extensive information.
