What Are the Timelines for RTI Applications?

The Right to Information (RTI) Act, 2005, empowers citizens in India to request information from public authorities, promoting transparency and accountability in governance. The RTI Act mandates specific timelines for public authorities to respond to requests for information.

Key Timelines Under RTI Act

  1. Response Timeframe:
    • Public authorities must respond to an RTI application within 30 days from the date of receipt of the request.
    • If the request is related to the life or liberty of a person, the information must be provided within 48 hours.
  2. Extension of Time:
    • If the request is forwarded to another public authority, the time taken for the transfer is included in the 30-day limit. However, the applicant should be informed about the transfer.
    • The RTI authority can extend the response time by another 30 days under certain circumstances, such as when the information sought requires consultation with other departments or requires substantial retrieval effort.
  3. Exemptions and Denials:
    • If the information requested falls under any exemptions specified in the Act (e.g., national security, personal privacy), the authority must provide a reason for denial within the stipulated response time.
  4. Appeal Process:
    • If a request is denied or not responded to, the applicant has the right to file an appeal. The first appeal must be filed within 30 days of the response or non-response.
    • The authority handling the first appeal is required to respond within 30 days from the date of receipt.
  5. Second Appeal:
    • If the first appeal does not yield satisfactory results, a second appeal can be filed with the State Information Commission (SIC) or Central Information Commission (CIC) within 90 days of receiving the decision from the first appellate authority.
