What Are The Types Of Tamliknama?

Answer By law4u team

A Tamliknama is a legal document used in India to transfer ownership or rights of property from one person to another. It is commonly used in family settlements, gifting property, or transferring assets through legal means. There are different types of Tamliknama, depending on the nature of the transfer and the circumstances involved.

Types of Tamliknama

  • Gift Deed (Hiba): This type of Tamliknama involves the transfer of property as a gift, often between family members. Under Muslim law, it is known as Hiba, and no monetary exchange is required. It is an irrevocable transfer of ownership from the donor to the donee.
  • Settlement Deed: This is a type of Tamliknama where property is transferred as part of a family settlement or agreement. It usually occurs to resolve disputes or distribute assets among family members in an amicable manner.
  • Partition Deed: When joint family property is divided among co-owners or family members, a partition deed serves as a form of Tamliknama to legally transfer individual ownership of each portion.
  • Will (Vasiyat): A will is a Tamliknama executed by an individual to transfer property or assets after death. It outlines how the property will be distributed to heirs or beneficiaries as per the deceased's wishes.

Summary

Types of Tamliknama include gift deeds, settlement deeds, partition deeds, and wills. Each type serves a specific legal purpose, whether it's gifting property, settling family disputes, dividing property, or transferring assets after death.
