What rights do foreign nationals have in India?

Foreign nationals in India enjoy several legal rights, but they are more limited than the rights of Indian citizens. Under the Constitution of India, rights are classified into fundamental rights available to all persons and rights reserved only for citizens. Rights available to foreign nationals: Right to equality before law Article 14 applies to all persons, including foreigners. Protection of life and personal liberty Article 21 applies to every person in India, including foreign nationals. Protection against arbitrary arrest Foreign nationals have legal safeguards under criminal procedure laws. Right to legal remedy They can approach Indian courts, including High Courts and Supreme Court. Freedom of religion (limited) They can practice religion freely subject to public order, morality, and health. Right to property (restricted) Foreign nationals can own property in certain cases as per FEMA and other regulations. Rights NOT available to foreign nationals: Freedom of speech and expression (Article 19) in full extent Right to vote Right to hold public office Right to reside and settle freely in India as a matter of citizenship Important restrictions: Immigration laws regulate entry, stay, and exit Foreigners must comply with visa and registration rules Government can deport foreign nationals under law Important point: Foreign nationals are protected by law while in India, but their political and constitutional rights are limited compared to Indian citizens.

Dear Client, Foreign nationals in India enjoy a specific set of fundamental rights guaranteed by the Constitution of India though they do not possess the full range of rights reserved for Indian citizens. Most notably they are protected under Article 14 that is equality before the law Article 20 protection in respect of conviction for offenses Article 21 right to life and personal liberty and Article 21A right to elementery education. They also benefit from protection against arbitrary arrest and detention under Article 22 the right against exploitation including prohibition of forced labor under Article 23 and child labor Article 24 and further the freedom to practice and propagate their religion Articles 25 to 28. Conversely, certain fundamental rights are strictly reserved for Indian citizens and are not available to foreign nationals. These include protection against discrimination on grounds of religion, race, caste, sex and place of birth that is Article 15 equality of opportunity in matters of public employment Article 16 and six freedoms under Article 19 which includes the freedom of speech the right to assemble peacefully the right to form associations the right to move freely throughout India the right to reside and settle in any part of India and the right to practice any profession occupation or trade. Additionally foreign nationals do not have the right to vote or hold certain public offices and their presence in India is subject to the provisions of the Immigration and Foreigners Act 2025 which regulates their entry stay and departure. To remain legally compliant foreign nationals must adhere to several administrative obligations depending on the nature of their visa. If you are on a long term visa exceeding 180 days you are generally required to register with the Foreigners regional registration officer or Foreigners registration officer within 14 days of your arrival. You must also keep your residential permit updated inform the authorities of any change in your registered address and surrender your registration certificate before your final departure from the country. Failure to comply with these regulations can lead to penalties or even deportation under the prevailing immigration rules.
