They must have been unable to live together as a married couple. They must mutually agree to dissolve the marriage. Filing a Joint Petition: Both spouses must file a joint petition for divorce in the family court that has jurisdiction over their case. The petition should state the reasons for seeking divorce and the terms of the settlement. Mandatory Waiting Period: After filing the joint petition, there is a mandatory waiting period of six months. This cooling-off period is intended to give the couple time to reconsider their decision.
