What compensation can be claimed for loss caused by defective online services?

  • Free Services: If the service failure was minor but still caused inconvenience, some service providers may offer free extended services or a compensatory benefit (such as additional months of service).

5. Punitive Compensation (In Case of Fraud):

  • Compensation for Fraud: If the defective service was a result of fraud (e.g., a fake subscription service or misleading online product advertisements), consumers can seek punitive compensation in addition to the actual damages.
  • Damages for Intentional Deception: Courts may award additional damages if the service provider intentionally misled the consumer to gain financial benefit.

6. Compensation for Breach of Contract:

  • Non-fulfillment of Agreement: If an online service provider fails to honor its contractual obligations, the consumer is entitled to claim damages for breach of contract. This can include compensation for loss of use of the service and any inconvenience caused by the breach.
  • Delay in Service: If the service involves timely delivery (e.g., online food delivery, travel bookings, or event tickets) and there is a delay or non-performance, consumers can claim compensation for any losses suffered due to the delay.

Steps to Claim Compensation for Defective Online Services:

1. Contact the Service Provider:

The first step is to contact customer support and attempt to resolve the issue amicably. Clearly state the problem and request a refund or other compensation.

If there is a grievance redressal mechanism in place, file a formal complaint, providing all relevant details (transaction records, communications, etc.).

2. Escalate the Complaint:

If customer support does not provide a satisfactory resolution, escalate the complaint to a supervisor or manager.

Follow up with written correspondence, detailing the issue and your demand for compensation.

3. File a Complaint with Regulatory Authorities:

Depending on the nature of the service, you can file a complaint with consumer protection authorities like the National Consumer Helpline (NCH) or sector-specific regulators (e.g., Telecom Regulatory Authority of India (TRAI) for telecom services).

District Consumer Forum:

Scenario: A consumer subscribed to an online streaming service that promised high-definition video quality. However, the service consistently delivered low-quality video streaming and failed to resolve the issue despite several complaints. The consumer paid for an annual subscription, but the service was defective and not fit for its intended purpose.

  • The consumer contacts customer support but receives no satisfactory resolution.
  • The consumer escalates the issue to a supervisor and requests a refund for the unused portion of the subscription.
