Under the Consumer Protection Act, 2019, and other e-commerce regulations, online platforms are responsible for vetting the products listed for sale. Consumers can report violations to ensure that these banned products are removed and marketplaces are held accountable.

Steps to File Complaints Against Online Marketplaces Selling Banned Products:

1. Identify the Banned Product and Gather Evidence:

  • Document the product: Take screenshots of the product listing, including the product description, price, and seller details.
  • Verify the product’s banned status: Ensure that the product is indeed banned by checking government regulations or product safety standards (e.g., illegal drugs, counterfeit goods, or products with unsafe ingredients).
  • Store receipts or proof of purchase: Keep a record of your order confirmation, shipping details, and payment receipt.

2. Contact the Online Marketplace’s Customer Support:

  • Raise a complaint with the marketplace: Most e-commerce platforms have a customer support system through which consumers can report issues. Use their Report Product or Complaint function to notify them about the sale of banned products.
  • Provide detailed information: Mention the product name, the seller, and the nature of the violation (e.g., illegal or banned product) and ask for immediate removal and investigation.

3. Escalate the Complaint:

  • If the issue is not resolved through customer support, escalate the complaint to a supervisor or higher authority within the platform.
  • Request specific actions, such as product removal, suspension of the seller’s account, or a refund if you’ve already made a purchase.

4. Report to Regulatory Authorities:

  • Consumer Protection Authority: File a complaint with the National Consumer Helpline (NCH) or the State Consumer Protection Authority for violations related to consumer rights and unsafe products.
  • E-Commerce Guidelines Enforcement: Under the Consumer Protection (E-Commerce) Rules, 2020, online platforms are responsible for ensuring that illegal or banned products are not sold. You can report to the Ministry of Consumer Affairs or relevant regulatory bodies.
  • Bureau of Indian Standards (BIS): If the product violates safety or quality standards, you can file a complaint with BIS or other product-related regulatory bodies.

5. File a Complaint with the Police or Cyber Crime Cell:

  • If the product sold is illegal or a criminal offense (such as drugs, counterfeit items, or unsafe electronics), you should report the issue to the local police or cybercrime cell. They may take action against the seller for violating the law.
  • Provide all available evidence (product images, communication with the marketplace, and transaction details) to assist in the investigation.

6. File a Complaint with the Consumer Forum:

  • If the marketplace fails to act or resolve your complaint, you can approach the consumer court under the Consumer Protection Act, 2019.   • The consumer contacts customer support of the marketplace, raising concerns about the illegal product and requesting a refund and removal of the listing.

  • The consumer reports the issue to the Consumer Protection Authority and files a complaint with the Food Safety and Standards Authority of India (FSSAI), as the product violates safety regulations.
  • The consumer files a complaint with the District Consumer Forum, claiming a refund for the defective product, compensation for health risks, and punitive damages.
  • The consumer also reports the matter to the local police, as the product is counterfeit, which constitutes fraud.
