Steps to File a Complaint Against a Doctor or Hospital

Document the Issue

  • Keep a record of all medical treatments, prescriptions, tests, and other relevant documents such as medical bills, discharge summaries, and consent forms.
  • If the doctor’s actions (misdiagnosis, incorrect treatment, surgical errors) caused harm, gather evidence to support your claim, including any medical records that prove the negligence.

Approach the Doctor or Hospital Directly

  • First, try to resolve the issue directly with the doctor or hospital. Many healthcare facilities have an internal grievance redressal mechanism.
  • Submit a formal written complaint to the hospital administration, stating the problem, how it was caused, and what compensation or resolution you seek. Hospitals often have a patient grievance cell to address such issues.

Seek an Expert Opinion

  • If you believe that the medical error or negligence is severe, seek an opinion from another qualified doctor or medical professional who can confirm that the treatment provided was below the standard of care.
  • This expert opinion will be essential when filing a complaint in the consumer forum or court.

File a Complaint with the District Consumer Forum

If the issue is not resolved satisfactorily by the doctor or hospital, you can file a complaint with the District Consumer Forum. The forum is empowered to deal with consumer grievances related to medical negligence.

Details to include in your complaint:

  • Personal details (name, address, contact information).
  • Details of the treatment or service (name of doctor, hospital, date of treatment).
  • Description of the negligence or poor service (including a timeline of events, and the harm caused).

    • Expert opinion that confirms negligence.
    • Photographs (if applicable), e.g., if you have visible injuries from a surgical error.

Attend the Hearing

  • The District Consumer Forum will schedule a hearing where both parties (you and the doctor/hospital) present their cases. You will need to be present at the hearing with all your evidence.
  • The hospital/doctor may be required to explain the treatment provided and justify their actions. The forum will review all the evidence and pass a ruling.

Await the Decision

After reviewing the case, the forum will pass a judgment. If the doctor or hospital is found liable for negligence, the forum may order them to pay compensation for the harm caused, offer a refund for the treatment, or provide other remedies.

  • If the consumer is not satisfied with the decision, they can appeal to the State Consumer Commission or National Consumer Commission depending on the value of the claim.
