What is the procedure to file a complaint online?

Answer By law4u team

With the advancement of digital platforms, filing a consumer complaint online in India has become easier and more efficient. Consumers now have the option to file complaints with consumer forums, the National Consumer Helpline (NCH), or through State Consumer Commissions using online channels. This process allows for quicker grievance redressal without the need for physical visits to consumer courts.

Procedure to File a Complaint Online

1. Visit the Official Online Consumer Complaint Portal

  • National Consumer Helpline (NCH): The National Consumer Helpline is a government-run portal that helps consumers file complaints and seek advice on consumer-related issues.
  • Consumer Court Websites: Every State Consumer Forum and District Consumer Forum now has an online portal where consumers can file complaints.
  • Consumer Protection Portal: This is a dedicated government portal for lodging consumer complaints. The portal is integrated with NCH.

2. Create an Account (If Required)

  • Many online platforms require you to create an account with your email address and phone number.
  • If you are a first-time user, register with your personal details to get started.

3. Choose the Appropriate Forum or Platform

  • Depending on the value of your claim and the nature of your complaint, you will have to choose the correct forum to file your complaint.
  • If your complaint is for defective goods or services valued below ₹1 crore, it should be filed at the District Consumer Forum.
  • For amounts between ₹1 crore to ₹10 crore, it goes to the State Consumer Commission.
  • Claims above ₹10 crore should be filed at the National Consumer Commission.
  • The NCH portal will automatically guide you to the right platform based on the details you provide.

4. Fill in the Complaint Form

  • The complaint form will ask you to provide basic details:
    • Consumer's name, address, and contact details.
    • Opposite party details (e.g., the business, manufacturer, seller, or service provider you are filing the complaint against).
    • Complaint description, including the nature of the complaint, the defect, and how you were harmed or inconvenienced.
    • Compensation or remedy you are seeking (refund, replacement, compensation, etc.).
  • You will also need to upload supporting documents like:
    • Invoice/receipt of purchase or service.
    • Proof of communication with the company (e.g., emails, letters).
    • Photographs or other evidence of the defect.
  • You may need to answer specific questions regarding the nature of the deficiency or unfair trade practice involved.

5. Upload Required Documents

  • Documents such as:
    • Receipt of purchase or transaction.
    • Warranty card (if applicable).
    • Photographs showing the defect or issue.
    • Emails or messages with the seller/service provider.
  • Make sure to scan and upload clear and readable copies of these documents in the required format (PDF, JPG, PNG).

6. Pay Any Necessary Fees (If Applicable)

  • While consumer forums generally do not charge any fees for filing complaints under the Consumer Protection Act 2019, some states or specific forums may have nominal processing fees.
  • Payment gateways on the portals allow for online payments if any fee is applicable.

7. Submit the Complaint

  • After filling out the complaint form and uploading documents, review the details carefully.
  • Submit the complaint. Once submitted, you will receive an acknowledgment number or reference number. Keep this number for future tracking and communication regarding your case.

8. Track the Complaint Status

  • After submission, you can track the status of your complaint through the online portal.
  • Most portals offer a status tracking feature that allows consumers to see updates on their complaint and when it is being processed or scheduled for a hearing.

9. Await the Response from the Consumer Forum

  • The consumer forum will examine your complaint and may issue a notice to the opposite party.
  • If the complaint is found to be valid, the forum may direct the seller or service provider to resolve the issue.
  • The forum will then schedule a hearing (if required) and provide the consumer with a hearing date.

10. Further Actions

  • If the complaint is resolved amicably, you will receive the remedy (e.g., refund, replacement, or compensation).
  • If the forum’s initial decision is not in your favor, you may have the right to file an appeal at the State or National level.

Example of Filing a Complaint Online

Case Example: A consumer purchased a smartphone worth ₹35,000, but it stopped functioning within a month of purchase. Despite contacting the seller for a refund or replacement, the issue remains unresolved.

  • Steps for Filing Online:
    • Visit the National Consumer Helpline (NCH) website.
    • Create an account or log in to the platform.
    • Select the appropriate forum (District Consumer Forum) based on the claim amount.
    • Fill in the complaint form, providing personal and seller details, and describe the issue.
    • Upload the purchase receipt, warranty card, and photographs of the defective phone.
    • Submit the complaint and pay any applicable fees (if required).
    • Track the status of the complaint through the online portal.
    • Await the response from the forum and resolution of the issue.

Conclusion

  • Filing a consumer complaint online in India has become a streamlined and accessible process with the availability of consumer protection portals like NCH and State Consumer Commission websites.
  • By following the steps of registration, filling out the form, submitting supporting documents, and tracking your complaint, consumers can ensure faster and more efficient redressal of their grievances.
  • This digital process reduces the need for physical presence and facilitates consumer rights enforcement.
