How to file complaints against deceptive pricing?

Deceptive pricing refers to practices where sellers or service providers misrepresent the price of a product or service to deceive consumers. Common examples include false discounts, inflated prices, or hidden charges that are not disclosed clearly before the purchase. This practice is a violation of consumer rights, and it harms consumers by causing financial loss or distress.

Under the Consumer Protection Act, 2019, consumers have the right to file complaints against deceptive pricing, and they are entitled to seek remedies such as refunds, cancellation, or compensation. E-commerce platforms and physical stores are both subject to scrutiny under these laws for fair pricing.

Examples of Deceptive Pricing

  • False Discounts: A retailer advertises a product as being 50% off when the original price was artificially inflated before the discount.
  • Hidden Fees: Online platforms list a product price but add hidden charges (such as shipping, packaging, or service charges) that significantly raise the final cost.
  • Bait-and-Switch Pricing: A store advertises a low price for a product, but when the consumer attempts to purchase it, they are told the item is out of stock and offered a more expensive alternative.
  • False Comparative Pricing: Sellers claim a product is being offered at a discount by comparing it with a false higher price (i.e., a price that was never actually offered or sold).
  • Bundling: The seller advertises a discount on a bundle of items, but when individual item prices are considered, the deal is either overpriced or non-existent.

Legal Rights of Consumers Against Deceptive Pricing

  • Right to Fair Price: Consumers have the right to pay a fair price for goods and services without misleading pricing tactics like false discounts or hidden charges.
  • Right to Be Informed: Consumers must be informed about the true price of products, including any additional fees or charges.
  • Right to Protection from Fraudulent Practices: Misleading advertisements or pricing fraud is considered an unfair trade practice under the Act. Consumers are entitled to file complaints and seek compensation.
  • Right to Refund/Compensation: If a consumer is misled by deceptive pricing, they are entitled to a refund or compensation for the loss caused.

Steps to File Complaints Against Deceptive Pricing

Step 1: Contact the Seller or Platform

  • Initial Complaint: The first step is to reach out to the seller or e-commerce platform directly. Most online platforms have a customer service or grievance redressal system where you can report issues related to misleading pricing.
  • Provide Evidence: Be sure to provide evidence of the deceptive pricing, such as screenshots, advertisements, invoice details, or promotional emails showing false prices or hidden fees.
  • Request a Resolution: Clearly state your complaint, whether you are requesting a refund, cancellation, or price adjustment. You may also ask for compensation if the deceptive pricing caused financial loss or inconvenience.

Step 2: Review the Seller's Terms and Conditions

  • Return/Refund Policy: Review the terms and conditions or return/refund policy of the seller or platform to understand the process for handling complaints related to deceptive pricing. Ensure you know the time limits and conditions for requesting a return or refund due to pricing errors.
  • Pricing Transparency: Check whether the seller has provided clear and transparent pricing. If the terms of sale were misleading, this can strengthen your case.

Step 3: File a Formal Complaint with Consumer Forum

  • District Consumer Forum: For claims up to ₹1 crore.
  • State Consumer Forum: For claims between ₹1 crore and ₹10 crore.
  • National Consumer Forum: For claims above ₹10 crore.

Filing the Complaint:

  • Prepare Documents: Gather evidence such as purchase receipts, screenshots of misleading prices, communications with the seller, and details of the deceptive pricing practice.
  • Submit Online or In Person: You can file a complaint either online through the National Consumer Helpline or in person at the relevant consumer forum.
  • Attend the Hearing: If the forum schedules a hearing, attend it and present all evidence to support your claim.

Step 4: Seek Legal Advice (If Necessary)

  • If the consumer forum does not provide a satisfactory resolution, or if the pricing issue is particularly complex, you may choose to seek legal assistance. A consumer lawyer can help file a civil lawsuit for breach of contract or unfair trade practices and guide you through the legal procedures for claiming compensation.

What Compensation Can Be Claimed?

  • Refund: If the consumer was misled by false pricing, they are entitled to a full refund of the amount paid.

Scenario: A consumer sees an online advertisement for a laptop with a 40% discount. The product’s original price is listed as ₹60,000, which is supposedly marked down to ₹36,000. However, after purchasing the laptop, the consumer realizes that the product was always priced at ₹36,000 and the 40% discount was a marketing gimmick.

Steps Taken:

  • Contact the Seller: The consumer contacts the seller and requests an explanation for the deceptive pricing. They demand a refund for the difference between the actual price and the advertised discount.
  • Formal Complaint: When no resolution is offered, the consumer files a formal complaint with the consumer forum citing false advertising and misleading pricing.

Outcome: The forum rules in favor of the consumer, ordering the seller to refund the amount overcharged and compensate the consumer for the inconvenience caused by the misleading advertisement.
