How to file complaints against fraudulent real estate agents?

Real estate transactions, whether it's buying, selling, or renting properties, often involve significant amounts of money and legal obligations. Unfortunately, some real estate agents engage in fraudulent activities such as misrepresentation, false promises, illegal practices, or unlicensed operations to deceive clients and make a profit. This can lead to significant financial losses for consumers.

Under the Consumer Protection Act, 2019, consumers have the right to protect themselves against such fraudulent activities by filing complaints and seeking legal recourse. In cases where real estate agents mislead or cheat consumers, they can approach Consumer Court for compensation, contract cancellation, or even penal actions against the fraudsters.

Common Types of Fraud by Real Estate Agents

  • Misrepresentation of Property: Agents may misrepresent the condition, location, pricing, or legality of a property.
    • Example: An agent may falsely claim a property is legally clear of disputes when it has a title issue or pending litigation.
  • Fake Documents: Fraudulent agents may present fake or forged documents related to property ownership, land titles, or no-objection certificates.
    • Example: Selling a property with forged ownership papers or misrepresenting the property's actual size or features.
  • False Promises: Agents might make false promises regarding the property's future appreciation, rentals, or financing options to convince the consumer to make a hasty decision.
    • Example: An agent claims that a property's value will double in the next year, enticing the consumer to make a purchase based on this false information.
  • Charging Unexplained Fees: Some agents may charge unjustified or hidden fees such as service charges, registration fees, or additional commissions that were not initially disclosed.
    • Example: An agent demands a high processing fee even after the deal is done, without explaining the cost.
  • Selling Non-Existent Properties: In some cases, fraudulent agents may advertise properties that do not even exist or are still under construction without the proper licenses.
    • Example: Agents advertising properties that are yet to be built or selling a flat that does not exist at all.
  • Unlicensed or Fake Agents: Some agents operate without valid licenses or certifications, making them illegitimate players in the market.
    • Example: A person acting as an agent without being a registered real estate agent or broker.

Steps to File Complaints Against Fraudulent Real Estate Agents

Step 1: Attempt to Resolve the Issue with the Agent or Agency

  • Initial Discussion: Before escalating the issue, attempt to resolve the matter by discussing it with the agent or their real estate agency. Present your concerns and demand a resolution such as refund, cancellation of agreement, or compensation.
  • Keep Records: Maintain records of all communications, agreements, and transactions with the agent, including emails, phone call logs, and receipts for payments made.

Step 2: Review the Contract or Agreement

  • Check the Agreement: If you have signed a contract or agreement with the real estate agent, carefully review the terms, including any clauses regarding cancellations, dispute resolution, or charges. This will give you insight into the legal standing of your case.
  • Breach of Contract: If the agent has violated the terms of the agreement or failed to deliver as promised, it strengthens your case for filing a complaint.

Step 3: File a Complaint with the Real Estate Regulatory Authority (RERA)

  • RERA Complaint: Every state in India has a Real Estate Regulatory Authority (RERA), which is responsible for regulating the real estate industry. If the agent is registered with RERA, you can file a complaint with the respective state's RERA authority.
  • RERA's Role: RERA provides a platform to resolve disputes related to real estate fraud, such as misrepresentation of properties or non-fulfillment of promises by the agent.
  • Process: You can file a complaint online or offline with RERA. The complaint will be reviewed, and RERA can order the agent to compensate you or even blacklist the agent in some cases.
  • Website: Each state’s RERA website allows consumers to lodge complaints and track the status.

Step 4: File a Consumer Complaint with the Consumer Forum

  • District Consumer Forum: For claims up to ₹1 crore.
  • State Consumer Forum: For claims between ₹1 crore and ₹10 crore.
  • National Consumer Forum: For claims above ₹10 crore.

Filing the Complaint:

  • Gather Evidence: Collect all relevant documents, including the contract with the agent, payment receipts, email exchanges, advertisements, and any evidence of the fraudulent actions (e.g., fake documents, misrepresentation).
  • Submit the Complaint: You can file the complaint either online through the National Consumer Helpline or in person at the relevant consumer forum. Ensure all documents are properly attached.
  • Pay the Filing Fee: There is a nominal fee associated with filing the complaint based on the value of the claim.
  • Attend the Hearing: The forum may schedule a hearing where both parties (you and the agent/agency) will present their cases. Make sure to attend and present your evidence clearly.

Step 5: Take Legal Action (If Necessary)

  • Civil Suit: If the consumer forum does not resolve the issue to your satisfaction, or if the case involves a higher monetary value, you can pursue a civil suit in a civil court for breach of contract, fraud, or damages.
  • Criminal Charges: In extreme cases where the fraud involves significant financial loss or criminal activities (e.g., selling non-existent property, using fake documents), the police may register a criminal case under Sections 406 (Criminal Breach of Trust) and 420 (Cheating) of the Indian Penal Code (IPC).

What Compensation Can Be Claimed?

  • Refund: You can claim a full refund of any amount paid to the agent, especially if the property was misrepresented or a deal was canceled due to fraudulent actions.
  • Compensation for Loss: If the fraudulent actions resulted in financial loss, you may be entitled to compensation for any damage, such as the cost of lost opportunities, travel costs, or additional charges incurred due to the fraud.
  • Legal Costs: You can also claim compensation for legal costs incurred while dealing with the fraud, including court fees and any costs related to hiring legal counsel.
  • Punitive Damages: If the real estate agent’s actions were particularly egregious or malicious, you may be entitled to punitive damages in addition to a refund or compensation.

Example

Scenario: A consumer hires a real estate agent to help purchase a flat in a new development. The agent shows them the property, and they are assured that the building is legally clear and ready for possession in 3 months. The consumer makes an advance payment of ₹15 lakh. However, 6 months later, the agent informs the consumer that the project is delayed and that the developer is not even registered. The consumer discovers that the agent misrepresented the status of the project.

Steps Taken:

  • Contact the Agent: The consumer contacts the agent, but the agent denies responsibility, claiming that the project delay is out of their control.
  • File Complaint with RERA: The consumer files a complaint with RERA, providing evidence of the agent's false claims.
  • File Complaint with Consumer Forum: Since the agent is unlicensed, the consumer files a complaint with the District Consumer Forum, demanding a refund and compensation for the loss incurred.

Outcome: The forum rules in favor of the consumer, ordering the agent to return the ₹15 lakh advance, plus compensation for the mental distress and additional costs incurred due to the fraudulent actions.
