A Qazi plays an important role in Muslim marriages and disputes under Islamic law (Shariah). Though not a government-appointed judge in India, a Qazi performs religious and legal functions in the Muslim community. Role of a Qazi in Muslim Marriages Solemnization of Nikah (Marriage) The Qazi conducts the Nikah ceremony, ensuring it follows Islamic principles. Verifies the Ijab (offer) and Qubool (acceptance) between the bride and groom. Ensures the presence of two Muslim male witnesses (or one male and two females). Records the Mahr (dower) agreed upon. Issuing Nikahnama (Marriage Certificate) Prepares and certifies the Nikahnama, a written proof of marriage. This document is important for legal recognition of the marriage. Guiding on Marriage Laws Advises couples on Islamic marital rights and responsibilities. Ensures the marriage complies with Shariah and Indian law. Role of a Qazi in Dispute Resolution Mediation in Marital Disputes Acts as a mediator in cases of family disputes, divorce, and maintenance issues. Encourages reconciliation between spouses before divorce. Talaq (Divorce) Procedures Oversees Talaq-e-Sunnat (approved form of divorce). In cases of Khula (wife-initiated divorce), ensures proper consent. Issuing Fatawa (Religious Opinions) Can provide religious rulings (Fatwas) on marital and personal issues. Not legally binding but followed by many in the community. Legal Status of a Qazi in India A Qazi is not a judicial authority under Indian law. Decisions are not legally binding unless accepted by both parties. Indian courts follow the Muslim Personal Law (Shariat) Application Act, 1937, but legal disputes are ultimately resolved by civil courts.
